This permit is subject to compliance with this application, site
drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine,
imprisonment or civil action; and may cause the permit to be-
come null and void.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
adjacent riparian landowners certifying that they have no
objections to the proposed work.

Enclosed please find a copy of the approved contract and technical specifications for
removal of hurricane related debris from marshes adjacent to Surf City and North Topsail Bearb,
Onslow County, North Carolina.
To accomplish this task it is my understanding that a General Permit 1900 must be

AGREEMENT
TIUS AGREEMENT, made the 2"d day of February, 1998, by and between the COUNTY OF
ONSLOW, hereinafter called the "OWNER" and T. B. Powell, Inc. doing business as (an
individual), or (a partnership), or (corporation) hereinafter called " CONTRACTOR
VVITNESSETH:
That for and in consideration of the payment and agreements hereinafter mentioned:
The CONTRACTOR will commence and complete the MARSH DEBRIS RE, MOVAL.
2. The CONTRACTOR. will furnish the materials, supplics, tools, equipment, labor and other
services necessary for the construction and completion of the PROJECT described herein.
3. The CONTRACTOR will commence, the work required by the CONTRACT
DOCUMENTS within seven (7) calendar days after the date of NOTICE TO PROCEED
and will complete the same %Aiihin ninety (90) calendar days unless the period for
completion is extended otherwise by the CONTRACT DOCUMENTS. The
CONTRACTOR. & ther agrees to pay the sum of $250.00 per day as liquidated damages
to the OWNER for each calendar day that the work exceeds the period so stated.
4. The CONTRACTOR agrees to perform all of the WORK described in the CONTRACT
DOCUMENTS and comply with the terms therein for the sum of $388,204.00, or as
shown in the BID Schedule.

MARSH DEBRIS REMOVAL
SECTION 402
1. SCOPE
This work shall consist of the cleanup of designated marsh and high ground areas by the removal
of debris, houses, decks, appliances, tires, rubbish, and other related materials of a manmade
nature deposited in and adjacent to the marsh by the stone of September S and 6, 1996, and the
revegetating of areas disturbed by the Contractor (sec item 8, below). The designated sites are as
shown on the attached location map(s).
2. ACCESS
Access shall be as designated by the Government Representative and/or his representative unless
alternative routes are obtained by the Contractor and approved by the Government
Representative.
3. L1IvlITS OF WORK
The Iimits of the work area shall not exceed those shown on the drawings Of this specification.
The limits of the designated marsh debris removal areas are referenced in the specifications and
on the maps.
4. CLEARING AND DEBRIS REMOVAL
Debris, houses, decks, appliances, tires, mbhish, and other related materials of a manmade nature
within the marsh and designated adjacent areas shall be removed and placed in a high ground
staging area for transport to an appropriate disposal area. Excavation of soiVseditnent shall not
be performed -
Disturbance to the marsh bottom , and equipment access areas shall be held to the minimum
necessary to allow the construction equipment to remove the debris.
5. DISPOSAL
Debris shall be placed in a designated staging area and transported for disposal in a appropriate
landfill or disposal areas. Alternative methods proposed by the Contractor for disposal of debris
must bepreapproved by the Government Representative.
Debris shall not be temporarily placed on hiking trails, sewer lines, water lanes, highways, or
railroad rights -of -way, etc. The debris shall be placed in the staging area so as to reduce
environmental impact to area.
6. ENVIRONMENTAL.. REQUIREMENTS
There shall be no fill activity associated with this work.

Temporary mats shall be required for all wetlands crossings_ These crossing locations shall be
selected, on a Site specific basis, by the Government Representative and/or his assigned Project
Manager, or a representative of the North Carolina Division of Coastal Management, and uill be
limited in number at each location.
Debris shall be picked up by equipment that does not require digging or earth moving in order to
avoid damage to wetlands.
Debris shall not be stockpiled on or within areas considered wetlands or waters of the State.
The final staging area shall be situated on suitable high ground.
Equipment shall operate adjacent to the wetlands area when feasible and practical. Crossing a
marsh to gain access to the debris, shall be accomplished at those sites so specified by the
Government Representative or his designated Project Manager, and/or as indicated by a member
of the North Carolina Division of Coastal Management. The Government Representative shall
select crossing sites to m iuimize daroage to the marsh and aquatic habitat.
Equipment shall be maintained to preveut fuel, oil, and lubricant spills. Refueling, repairs, and
lubrication shall be performed at safe distances from the marsh or wetlands areas. Should fuel
leaks, oil leaks or hydraulic Iine rupture occur during construction, the Contractor's operators
shall immediately remove the equipment to a safe high ground area and take prompt action to
minimize the damage and safeguard the site. The Contractnr or his Superintendent shall
immediately report the discharge to the North Carolina Division of Water Quality at (910) 395-
3900, and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act
shall be followed. The Contractor or has Superintendent shall also contact the Onslow County
Twergaaey Management Office, Hazardous Materials Coordinator at (910) 347-4270, and the
Ommer.
The Contractor shall provide tanks or barrels to be used for off site disposal of chemical
pollutants such as drained lubricating or transmission oils, greases, etc. produced as a by-product
of this work. Washing, fueling or servicing of equipment shall be avoided where spillage or
wash water can enter the marsh or wetlands areas or watercourses.
SPECIAL REQUIREMENTS
The Contractor shall submit to the Contracting Officer for his review and approval prior to
construction, a construction schedule showing the sequence of all work to be performed. The
Contractor shall complete all work at a site before moving to another site.
The Contractor shall exercise care while working in areas of e:dsting lawns, roads, structures,
utilities, railroads, other improvements and cropland. the Contractor shall be responsible for the
prompt repair or replacement of any such improvements damaged by his/her operations,
Fences which must be removed for access shall be removed with the minimum damage practical
and reinstalled as near to the original condition as possible immediately after construction access
is no longer needed at the site.
onsiow County will obtain the General permit 1900 from the Division of Coastat Managernem
for work covered by this bid document.

The Contractor shall be responsible for complying with all requirements of the NC I)ppartment
of Transportation's Manual of UA.i.,form Traffic Control Devices (MUl'CD) when work is '
performed on public rights -of -way. When equipment or personnel are operating on public rights -
of --way, flag open shall be stationed to warn oncoming traffic of congestion. Proper construction
road signs shall be in place. A means of removing sediment and/or debris from roadway shall be
establiahed. Residue deposited on roadways may be removed by sweep machines, manual
sweeping methods or pressurized water. The Contractor shall be responsible for implementation
ofthese measures.
S. REVEGETATiON
All ground surfaces denuded due to debris removal or equipment access shall be revegetated as
directed by the Government Representative or the Construction Inspector. Prior to revegetating,
any ruts or other surface irregularities resulting from this operation shall be smoothed and the
ground surface shall be returned to its original degree of uniformity as directed by the
Government Representative or the Construction Inspector. No ai-dl activity shall be associated
witb wetlands or waarsh areas.
9. EQUIPMENT .REQUIREMENTS
1 JI *aulic excavators shall be low ground pressure (LOP) machines and be equipped with a
stationary or mechanical thumb attachment or have a grapple. Rubber tine skidderc shall 6--
equipped with low ground pressure, high £iontation tires.
Each work site shall be have two-way communication capabilities. Tbis requirement will be met
with cellular phones or two-way battery operated radios. Radios shall have a broadest capability
o£a roinimum 5 watts and shall operate on a frequency of 151.625 MHz on the FM band.
Alternative frequencies may be used subject to the approval of the Government Representative.
10, MEASUREMENT AND PAYMENT
Mcthod of payment for Marsh Debris Removal is unit cost for the item(s) described. Such
payment shall be considered full compensation for all labor, equipment, tools. materials, seeding,
mobilization, demobilization and other items necessary and incidental to complete the work.
Quantities listed in the bid form shall be the maximum quantity allowed under this contract
without an approved change order authorized by the County of Onslow and approved by the
North Carolina Department of Emergency Management and the Federal Emergency
Management Agency. Quantities listed in the bid form are for contract purposes only.
It shall be the responsibility of the Contractor, to assure that all debris materials are quantified by
the Project Manager prior to transport to an approved landfill or recycling center. No debris
materials which have not been measured prior to transport to an approved landfill or recycling
center shall be submitted for payment under the terms and conditions of this contract.
Debris materials shall be placed in the approved staging area for measurement by the Project
Manager. Debris material placed in the staging area shall be quantified on a regular basis in a
manner mutually acceptable to the Project Manager and the Contractor.

Whcn feasible, debris materials xnay be loaded directly onto trucks for transport to an approved
landfill or recycling center .without being placed in the designated staging area. In this instance.
debris materials will be measured in the truck prior to transport to an approved landfill or
recycling eeAter.
It shall be the rc..pgnsibility of the Contractor to assure that debris materials in the staging arcs
from other jurisdictions are held separate and distinct from debris materials re rnoved under this
contract. Copies of all disposal tickets from the accepting landfill shall be provided to the Project
Manager. In addition, any loads taken to an approved recycler shall be certified by the receiving
facility and a load ticket (in tons, or cubic yards) provided to the Project Manager.
