Dear Sirs:
In response to the Adjacent Reparian Property Owner Notification/Waiver form sent
to Midyette Development Co., directed to Mrs.G.P. Midyette, (My deceased Mother) dated
11-18-97, which I received 11-28-97, requesting approval to extend the bulkhead at the corner
of Water Street and South Water streets in Oriental, N.C. Let me say that Midyette Development
Co., does vehemently object to the proposed work requested to be done by the town of Oriental.
Some of the reasons for this objection are as follows:
1) There is already a sufficient bulkhead in place at this site.
2) This proposal would create an encroachment of N.C. State owned
property which is unnecessary to provide adequate protection from
erosion at this site due to the bulkhead already in place.
3) To extend this bulkhead into Neuse River at this site would cost
tax payers of Oriental an unnecessary expense, since the current
bulkhead at this site provides satisfactory protection from erosion.
4) Rumor has it, this additional property derived by extending this
bulkhead at this spot would be used to place a public restroom facility.
This would be totally unacceptable to Midyette Development Co.,
I am confident it would create a public nuisance from the stand point
of being a haven for illegal drug usage, illegal sex acts as well as
being a potential health hazard, if not kept under guard and cleaned
daily. I do not believe the Town of Oriental is ready to commit to this
kind of expense and/or responsibility.
The Town of Oriental already has a very pleasant Town Park. If public restroom
facilities are needed, it seems to me that would be the most likely place to put them. However, I
am of the opinion, this type of facility is neither needed or desired by the majority of the tax
paying citizens of Oriental.

The Town of Oriental is in the process of constructing a bulkhead in the Town's street right of way
at the corner of Water and South Water Streets in Oriental. This bulkhead will allow the shoreline
at the roadside to be extended into the harbor the same distance as the shoreline of the adjacent
property owners`, such as the Midyette Development Co. Enclosed in this correspondence please
find a map of the area, indicating the site in question, as well as a letter that the Town would like
for the Midyette Development Co. to sign and return to the Town Hall in the self-addressed
stamped envelope as soon as possible. Your prompt return of this letter will greatly expedite the
Town of Oriental's CAMA permitting process for the bulkhead. If the Town receives no response
from you, we will have to proceed with this project through the proper, albeit more time consuming,
channels of the Division of Coastal Management.

Dear Mr. Crowe:
Charlie Gryb referred to me your letter of November 19,1997 regarding the proposal of the Town
of Oriental to construct a bulkhead in the land lying beyond the curb at the end of South Water
Street. The land lying beyond the curb at the south end of South Water is claimed by the Oriental
Yacht Club Under the deed from D.C. Goodwin et al to Oriental Yacht Club, Inc. dated May
15,1968 and recorded in Book 143 at page 525 of the Pamlico County Register of Deeds. The
northwest line is the southwest line of West Water street. This line was recognized by the Town
of Oriental when the Town approved the Oriental Harbor Development Company, Inc.
development plans which required the developers to keep 15 feet off the northwest line of the
Oriental Yacht Club's northwestern line as it extended south of this tract.
The Oriental Yacht Club is opposed to the proposed development at the location indicated on the
diagram attached to your letter. In addition The Yacht Club does not agree to waive any 15 foot
set back requirement to which the OrientalYacht Club is entitled.

TRACT TWO: BEGINNING at a point where the centerline of West Water Street
intersects the southeasternmost right of way line of Broad Street (North

minutes East 512.39 feet to a point which is located 9.50 feet beyond
the centerline of West Water Street; thence North 79 degrees 26 minutes
West to and with Smith Creek to another point; thence continuing with
Smith Creek North 45 degrees 11 minutes West 133.91 feet to another point;

Street 323.02 feet from the southern edge of Hodges Street right of way,

RESOLUTION
on of West Water Street in the Town of Oriental
which lies southeast of.South Water Street, as the same appears on the
map of the Town which is recorded �.n Map Book One at page 34 in the
Office of the Register of Deeds of Pamlico County (said map being dated
in 1900), has never been opened as a public street; and
WHEREAS said poftion of West Water Street was very low and marshy
and in the period following the year 1919, when the land on the northeast;
side of said portion of said street was acquired by E. R. Goodwin and C.
P. Goodwin, partners trading as Oriental Fish Company, said owners of
said land bulkheaded said land area along the shore of Raccoon Creek
or Smith Creek and -filled in the low area, creating usable land; and
WHEREAS since said land was raised and made usable as aforesaid,
said E. R. and. C. P. Goodwin and their successors in title to the lands
on the northwest side thereof have entered into possession of the lands
within the boundaries of said portion of said street and have continued
in possession thereof to the present time, have built and maintained
extensive improvements thereon, including a dock or pier and buildings,
the portion of said improvements in navigable water having been built
and maintained.under license from the United States Corps of Engineers,
and
WHEREAS said E. R. and C. P. Goodwin and their successors in title
have•acquired title to the land within the boundaries of said portion
of. West Water Street, including the southwest one-half thereof, and
have requested the Town of Oriental to formally abandon said street;
and
WHEREAS the rights of no person other than the owners of said
lands would be affected by the abandonment of said street;
NOW, THEREFORE, BE IT RESOLVED that the portion of West Water
Street which lies southeast of South Water Street in the Town of
Oriental, as the same is shown on the map of said Town which is re-
corded in Map Book One at page 34, Pamlico County Registry, be and the
same is hereby declared abandoned, it being the purpose of this 'resolu-
tion to cause all the right, title, interest and estate of the Town
of Oriental to revert to the owners of the fee simple title underlying
said portion of said street, they being D. C. Goodwin and E. R. Goodwin.

On the southeast side of South Water Street, bounded
on the northwest by said street, on the northeast by
the lands of Garland Fulcher, on the'southeast by
Raccoon Creek, and on the. southwest by Smith Creek,
BEGINNING at a point in the southeastern line of South
Water Street which'is located the following two
courses and distances from the intersection of the
centerlines of the pavements of South Water and Hodges
Streets: South 45 degrees 42 minutes West with the
centerline of South Water Street 456.47 feet; thence

Pamlico County Registry, the bearings therein being
magnetic for 1968.
ALSO conveyed herewith is the strip of land which is
bounded on the northwest by South Water Street, on the
northeast by the lot above -described, on the southeast
by Raccoon Creek and on the southwest by the south-
western line of West Water Street, said land being
now covered by water.
ALSO conveyed herewith, in addition to the buildings
and other improvements located upon the above -described
land, are the docks, piers, buildings and other struc-
tures and improvements which extend from said land

The northeastern 158'60� b'rMR4 said land -was-
conveyed to E. R. Goodwin by Keever Lewis and wife by
deed dated August 13, 1945 and recorded in Book 102
at page 269, Pamlico County Registry. E. R. Goodwin
and wife conveyed a one-half undivided interest therein
to D. C. Goodwin by deed dated October 6, 1947 and t
recorded in Book 105 at page 455 of said registry.
The center 30-foot, portion of said land was conveyed
by W. J. Smith and Son to E. R. Goodwin and C. P.
Goodwin, Trading as Oriental Fish Company, by deed
dated September 8, 1919 and recorded in Book 74 at
page 80 of said registry. Nancy J. Goodwin, sole
devisee of C. P. Goodwin, conveyed his undivided one-
half interest therein to E. R. Goodwin by deed dated
October 16, 1934 and recorded in Book 92 at page 144
of said registry. The remainder of the above -described
land was within the boundaries of West Water Street
according to the plan of the Town of Oriental. Said
street was never opened and by deed dated March 27,
1968 Robert P. Midyette, sole heir of Arthur F.
Midyette, owner of the residue of the said Town,
conveyed said land to D. C. and E. R. Goodwin. By
deed of the same date, Mattie B. McCabe, sole devisee
of L. F. McCabe, grantee of Arthur F. Midyette, also
' conveyed said land to D. C. and E. R. Goodwin.
TO HAVE AND TO HOLD the aforesaid lot or parcel of
land, together with all privileges -and appurtenances thereunto
belonging, to the said Oriental Yacht Club, Inc. and its success
and assigns in'fee simple forever.
And grantors, for themselves., their executors and
administrators, covenant,with grantee and its successors and
assigns, that they are seized of said premises in fee; that they
have a perfect right toiconvey the same'in fee simple; that the
some are free and clear of all encumbrances whatsoever; and that
they will warrant and defend the title to the same against the
lawful claims of all persons whomsoever.

Dear Mr. Manning:
DIVISION OF COASTAL MANAGEMENT
This correspondence is in reference to your letter of December 1, 1997 to Mr. William
Crowe, Oriental Town Manager, whereby you stated objections to a proposed vertical
bulkhead by the Town, at the corner of Water and South Water Street, adjacent Smith
Creek, in Oriental, North Carolina. The letter also confirms our recent telephone
conversation whereby you voiced concern over the proposed development at the site.
And although there is miscellaneous rock rip rap/concrete along the shoreline at the
project site, the Town has requested permission to install a vertical seawall at the
normal water line for shoreline protection. The normal water line was staked on
March 9, 1998.
The North Carolina Division of Coastal Management has given careful consideration
to your objections and has determined that the project is consistent with the pertinent
rules and regulations of the Division. Consequently, the Division issued a general
permit on April 30, 1998 authorizing construction of the vertical bulkhead at the
normal water line. I have enclosed a copy of the permit for your review.
If you wish to appeal this permit decision, you may file a request with the Director of
the North Carolina Division of Coastal Management, Department of Environment and
Natural Resources within 20 days of the permit decision. If you have any questions
regarding this matter, please don't hesitate to contact me at my Morehead City Office
