imprisonment or civil action; and may cause the permit to be-

To whom it may concern,
Mr. William Kwaak has our permission to install a temporary ramp on our property at
310 Front Street in Beaufort for the purpose of facilitating the removal of contaminated soil
from his adjacent property. It is our understanding that the ramp will be located at the
extreme western edge of our lot, the edge closest to his building. This permission is granted
only with the understanding that Mr. Kwaak will obtain all appropriate permits before
construction, that he will provide us with a copy of said permits, that he will coordinate the
construction timetable with us, and give us prior notice before beginning any construction. It
is further understood that the ramp shall be removed, and the lot and any improvements shall
be restored to their original condition before the end of the calendar year 1997.

Enclosed please find a letter from the NCMM and Dr Charles Aquadro
which you requested I obtain. Also a check in the amount of $50.00.
I propose to constuct a temporary structure twelve feet wide and 94
feet long starting at the sea wall and running parallel to my
building at 300 Front St.
The structure will be used by a loader to convey the soil from the
excavation site to a truck on Front St. Care will be taken to avoid
spillage of materials by having the loader bucket filled inside the
wall of the site.

MR. KWAAK AS PER SURVEY DATED 7-8-91, WHERE THE FUEL TANKS WERE
STORED.
UPON REMOVING THE FINAL AMOUNT OF CONTAMINATED SOIL FROM THE
ENCLOSURE, MR. KWAAK DECIDED HE WANTED TO FILL IN THE CONTAINMENT
AREA WITH NEW SOIL. AT THAT TIME HE CONTRACTED WITH STYRON
CONSTRUCTION AND REGGIE'S BOBCAT SERVICES (919) 726-5603 TO
HAUL NEW SOIL INTO THE CONTAINMENT AREA.
THE BRIDGE HAD SETTLED APPROXIMATELY 2 1/2 FEET FROM THE ENTRANCE
LEVEL, A DIRT RAMP WAS CONSTRUCTED OF CONTAMINATED DIRT AND
USED DURING THE REMOVAL PROCESS OF THE CONTAMINATED SOIL, BECAUSE
MR. KWAAK WANTED TO RENT THE BRIDGE, THE CONTAMINATED DIRT RAMP
WAS LEFT IN PLACE AS SHOWN ON SKETCH A-1.
WHEN I ARRIVED ON THE JOB SITE DECEMBER 9, 1997 MR. KWAAK
INSTRUCTED MYSELF, CHRISTOPHER JACOBS AND MR. JESUS BUSTAMANTE
TO LOAD APPROXIMATELY A TRUCKLOAD (APPROXIMATELY 1.2 THOUSAND
BOARD FEET) OF CONTAMINATED TIMBERS (WHICH HAD BEEN DUG OUT
OF THE CONTAMINATED AREA) INTO THE CORNER OF THE CONTAINMENT
PIT NEXT TO THE WET WELL AS SHOWN IN SKETCH A-2. MR. KWAAK,
REGGIE LEWIS OF REGGIE'S BOBCAT SERVICES AND JESUS BUSTAMANTE
AND MYSELF ALL LOADED THE CONTAMINATED TIMBERS INTO THE PIT
AT THE REQUEST OF MR. KWAAK.
INITIALLY, I WAS GOING TO REMOVE THE DIRT RAMP AND HAUL IT OFF
SITE BUT MR. KWAAK INSTRUCTED ME TO LEAVE THE DIRT RAMP. HE
REMOVED THE TRUCKS FROM THE SITE THAT WERE HAULING THE

WHEN OUR FIRM RETURNED THE NEXT DAY TO BEGIN REMOVING THE BRIDGE,
MR. KWAAK AND REGGIE LEWIS HAD PUT THE CONTAMINATED DIRT
(APROXIMATELY TWO TRUCK LOADS) THAT WAS BEING USED FOR THE RAMP
BACK INTO THE PIT AREA, USING THE CONTAMINATED DIRT AS FILL.
THIS WAS WITNESSED BY OVER TEN MEN. CONTAMINATED TIMBERS AND
DIRT ARE STILL IN THE PIT AREA.
COMMERCIAL ROOFING SYSTEMS, INC. FULLFILLED ITS CONTRACT
OBLIGATIONS REMOVING ALL THE CONTAMINATED MATERIAL FROM THE
CONTAINMENT AREA READY TO BE PLACED ON THE DUMP TRUCK. HOWEVER
WE WISH ALL PARTIES TO KNOW THAT THE DIRT IS STILL CONTAMINATED
BY OPERATIONS DONE BY MR. WILLIAM KWAAK AND THAT THE N.C.
DEPARTMENT OF ENVIRONMENTAL, HEALTH AND NATURAL RESOURCES AND
ANY PROSPECTIVE BUYERS SHOULD BE AWARE THAT THE PROPERTY IS
STILL CONTAMINATED.

with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void.
1. Any change or changes in the plans for development, construction, or land use activities
will require a re-evaluation and modification of this permit.
2. All material removed from the vault must be disposed of at a site approved by the
Division of Water Quality.
3. The temporary placement or double -handling of excavated or fill materials within waters or
vegetated wetlands is not authorized.
4. --No excavated or fill material will be placed at any time, in any marsh or surrounding waters.
5. All backfill material will be obtained from a highground source and confined behind the existing
concrete vault.
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
From the date of an appeal, any work conducted under this per-
mit must cease until the appeal is resolved.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
Any maintenance work or project modifications not covered
under this permit requires further written permit approval.
All work must cease when this permit expires on December

In 1974, the North Carolina General Assembly passed
the Coastal Area Management Act and set the stage for
guiding development in the fragile and productive areas
which border the state's sounds and oceanfront. Along
with requiring special care by those who build and
develop, the General Assembly directed the Coastal
Resources Commission (CRC) to implement clear regula-
tions which minimize the burden on the applicant.
This application for a minor development permit under
CAMA is part of the Commission's effort to meet the
spirit and intent of the General Assembly. It has been
designed to be straightforward and require no more
time or effort necessary from the applicant. Please go
over this folder with the Local Permit Officer (LPO) for
the locality in which you plan to build to be certain that
you understand what information he or she needs.
Under CAMA regulations, the minor permit is to be
issued within 25 days once a complete application is in
hand. Often less time is needed if the project is simple.
The process generally takes about 18 days. You can
speed the approval process by making certain that your
application is complete and signed, that your drawing
meets the specifications given inside and that your
application fee is attached.
Other permits are sometimes required for development
in the coastal area. While these are not CAMA-related,
we urge you to check with the Local Permit Officer to
determine which of these you may need. A listing is
included on page 2 of this folder.
We appreciate your cooperation with the North
Carolina Coastal Management Program and your
willingness to build in a way which protects the
resources of our beautiful and productive coast.

I acknowledge that the land owner is aware that the proposed development is planned for an area which may
be susceptible to erosion and/or flooding. I acknowledge that the local permit officer has explained to me the

Notice is hereby given that Mr. William Kwaak has applied to the Department of
Environment, Health and Natural Resources for a Minor Development permit. The applicant
is requesting to remove contaminated soil from a concrete vault which is located over the waters
of Taylors Creek and adjacent to Harpon Willie's, at 300 Front. Street in the Town of Beaufort.
Persons desiring to inspect the application, or to comment thereon, are directed to contact
Charles O. Pigott, Field Representative, Division of Coastal Management, in the Marine
Fisheries Building, Morehead City, NC, Telephone (919) 726-7021, no later than September 23,
1996. Comments received prior to that date will be considered in making the permit decision.

NCGS 113A-119(b) requires that Notice of an application be

notice at a conspicuous point along your property where it can be
observed from a public road. Some examples would be: Nailing the
notice card to a telephone pole or tree along the road right-of-way

Dear Charles:
I have enclosed the application for a minor permit, notified adjacent
property owners, included a site drawing and a $50 check.
The present plan is to bring in a working barge with a clamshell
bucket and position it against the dock in front of the South
containment wall. A second barge will be located adjacent to the
first onto which the soil will be transferred. The existing floating
docks and pillings will be removed temporarily to accomodate the
barges.
The fixed dock will be covered with canvas so as to prevent soil
spillage into Taylors Creek. Dry soil will be wet down with water to
contain dust.
The soiI will be transported by barge and transferred onto the
Merrimon property in a similar manner.I hope this meets with your
approval.

1. The landowner or his representative hereby authorizes the Permittee, county and state officials or their
representatives to inspect and, if necessary, take soil, surface and groundwater samples at each parcel of
property prior to, during, and after the permitted activity.
2. If a permit is issued to the Applicant (thus making him or her the Permittee), the landowner or his representative
will inform the Permittee of any applicable revisions or modifications to the intended use and cropping patterns
referenced in this document, prior to each planting seasoning, to enable the Permittee to amend this Agreement
so as to schedule permit -related activities at appropriate periods.
3. No crops for direct human consumption shalt be raised on this site for a period of 12 months following land
application of the soils containing petroleum products.
4. The landowner or his representatives or successors shall adhere to the provisions of this Agreement for a
period of eighteen (18) months from the date of the most recent soils application.
5. Should the landowner or his representative lease or otherwise permit the use of the land by a third party, the
landowner shall be responsible to insure that the third party agrees and complies with the terms and conditions
of this Agreement.
6. Animals should not be grazed on soil disposal lands within a one hundred eighty (180) day period following
the soils application. Application sites that are to be used for grazing should have fencing, or other equally
effective barriers, that will be used to prevent access during this period after application.

The following information is in reference to Part IV: Land Application at Conventional
Rates: One Time Application, number 2 , A-G.
A. and B. The soil found at the disposal site was Tomotley fine sandy loam. The surface
layer is dark gray fine sandy loam and is 7" thick. The subsurface layer is light
brownish gray fine sandy loam to a depth of 11 ". The subsoil extends to a
depth of 54" and is light brownish gray fine sandy loam in the upper part and
gray sandy clay loam in the middle and lower parts. The underlying material
to a depth of 80" is gray loamy fine sand. The structure of the soil, 0 to 12" is
weak medium granular , 11 to 35" is blocky and very friable, 35 to 54" is
massive, friable, slightly sticky and slightly plastic, 54 to 80" is massive and
friable.
C. Restrictive soil, horizons, or layers are not present.
D. The seasonal high water table was approximately 1.0' below the surface.
E. The slope of the site is nearly level.
F. and G. The following liming and fertilizer rates are based on the absence of a
soil test:
