violation of these terms may subject the permittee to a fine,
imprisonment or civil action; and may cause the permit to be-
come null and void.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
adjacent riparian landowners certifying that they have no
objections to the proposed work.

This correspondence is in reference to your request for the North Carolina
Division of Coastal Management to determine the extent of the Estuarine Shoreline on
property owned by Mr. Til Harris. The property in question is lot #19 in Silver Acres
ROGER N. SCHECTER Subdivision, adjacent Broad Creek, in the Community of Whortonsville. You also
DIRECTOR asked the Division to evaluate "the cut" which is located at the eastern end of the lot.
This letter also serves as a follow up to our recent telephone conversation.
I have been on the aforementioned lot several times in the past. In addition, I
have discussed the estuarine shoreline jurisdiction on the lot as well as provided Mr.
Skip Lee, Pamlico County Building Inspector and Local Permit Officer, with the
Division's opinion of the applicability of the Land Use Plan's permanent conservation
zone to the lot. As I recall, the Division does exert a 75' Estuarine Shoreline
jurisdiction along the entire shoreline including "the cut" which extends back into the
property. Likewise, since the subdivision was recorded in 1992, the 75' permanent
conservation zone should apply to the natural shoreline of Broad Creek. However,
after reviewing aerial photographs and topographic maps, it was determined that "the
cut" area is essentially a manmade canal and therefore the permanent conservation zone
should not apply to that particular area of the shoreline.
