Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

PAMLICO COUNTY AGREEMENT
THIS AGREEMENT, made this 28th day of September, 2004,
by and between MAURICE W. BENTON and wife, GLENDA G. BENTON,
hereinafter referred to as "the Bentons"; and ROBERT W. COWDEN
and wife, CAROL COWDEN, hereinafter referred to as "Cowdens";
W I T N E S S E T H:
WHEREAS, the Bentons own a tract of land on the north
side of N.C.S.R. 1325 which contains 70.25 acres, it being
described in that deed dated January 6, 1998, and recorded in
Deed Book 338 at page 339, Pamlico County Registry; and
WHEREAS, the Cowdens own a marina on the south side of
said road which also lies on Broad Creek; and
WHEREAS, the Cowdens have applied to have said creek
dredged and said permit requires an area to dispose of the dredge
material; and
WHEREAS, the Bentons have agreed to allow the Cowdens,
or their successor in title, to utilize a portion of their 70.25
acre tract for said purpose, subject to the terms and conditions
contained herein.
NOW, THEREFORE,

1. The Bentons do hereby convey to the Cowdens, and
their heirs and assigns, the right and easement to dispose of
approximately 1,000 cubic yards of dredge spoil over and upon the
following described portion of said tract:
BEGINNING at the southeast corner of the said 70.25
acre tract in the northern edge of N.C.S.R. 1325 and
the centerline of a ditch, and running thence North 000
28, West with said ditch centerline approximately 1100
feet to the centerline of an intersecting ditch; thence
westward with said intersecting ditch centerline across
to cuts of field 444 feet to the centerline of another
intersecting ditch; thence southward with said
intersecting ditch centerline to the northern edge of

road to the POINT OF BEGINNING.
2. This right and easement shall expire on January 1,

August, 1993, by and between SOUND PACKING CO., INC., hereinafter
called "grantor", and ROBERT W. COWDEN, Post Office Box 105,
Stonewall, North Carolina 28583, hereinafter called "grantee";

That grantor, for and in consideration of the sum of ten
dollars and other good and valuable considerations to it paid,
the receipt of which is hereby acknowledged, has bargained and
sold, and by these presents does bargain, sell and convey to the
said Robert W. Cowden, and his heirs and assigns, a certain tract
or parcel of land in Number Two (2) Township, Pamlico County,
North Carolina, particularly described as follows:
In the Village of Whortonsville, on the north side of
Broad Creek, west side of Coffee Creek and the southern
end of NCSR 1326, and beginning at an iron stake at the
southwest corner of the end of NCSR 1326 and running
thence from said POINT OF BEGINNING, South 85' 02' East
with the end of said road 60.00 feet to the southeast
corner of said road; thence North 04° 58' West with the
road edge 81.20 feet; thence South 87° 28' East 151.20
feet to the edge of Coffee Creek; thence South 20° 21'
West with the edge of the creek 36.06 feet to the
centerline of a bulkhead; thence with the centerline of
said bulkhead the following four courses and distances:
South 15° 47' West 204.85 feet, South 86° 37' West
107.73 feet, South 04° 08' West 22.65 feet, North-84°
59' West 43.96 feet; thence North 86° 02' West
approximately 53 feet to the western edge of a pier;
thence North 03° 34' East with the western edge of the
"Lounge" approximately 23 feet to the northwest corner
of the "Lounge"; thence with the edge of Broad Creek
North 42' 01' West 47.67 feet to grantor's southwest
corner; thence North 07° 54' East 110.60 feet; thence
North 77° 24' East 73.10 feet to the POINT OF BEGINNING,

Said land was conveyed to grantor by Wilson F. Whorton

together with all privileges and appurtenances thereunto
