Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

On 12/4/04, we received your letter dated 11/30/04 regarding the building of a concrete dock at
100 Windtide Lane, Havelock NC at Mitchell Harbor.
We are objecting to the project presently proposed for the following reasons:
1. Concrete Dock - all current docks and pilings are of treated wood
2. Failure to show the dock's impact at the mean high water line (12/23/97)
3. Failure to show pins/markers of lot line of out Lot D or Lot 8 (V&H Geraghty)
4. Failure to show the dock on construction plans
5. Failure to abide by Mitchell Harbor protective covenants
a. File an application for construction at Mitchell Harbor for "d)marine construction,
including docks, piers, bulkheading"
b. Show a copy of application to be sent to appropriate North Carolina Division of
Coastal Management, federal, county and local authorities and Mitchell Harbor
architectural committee.
C. Mail plans to members of Mitchell Harbor architectural committee
6. Failure to show or have appropriate company detail what affect a concrete dock would
have on other docks regarding silt buildup
7. Failure to show conformity and harmony of design with current docks
8. Will the concrete dock cause a need for dredging?
