Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythat this project is consistent with the North Carolina Coastal Management Program.

Dear Mr. Brownlow:
Enclosed please find documents intended to comply with the requirements to apply for a permit for a
bulkhead for our Emerald Isle sound front property, including a signed waiver from our western neighbors,
and a return receipt requested registered letter to our eastern neighbor, the town of Emerald Isle.
Our sound front erosion is largely the result of Hurricanes Fran and Bertha, as well as the existing bulkhead
on our western boundary. The incline of the slope from the line of erosion exceeds 45 degrees.
We look forward to a site visit from you to familiarize yourself with the existing conditions.

Dear Mr. Rush:
We live at 205 Arden Road to the west side of 9'h street on Bogue Sound. Dating back to
Hurricanes Fran and Bertha we have suffered considerable erosion to our sound front. We contacted the
Division of Coastal Management and were advised that in order to secure a permit for a bulkhead we
needed to communicate with our adjacent property owners that "they have been notified by certified mail
with return receipt, and that they have been given the opportunity to comment to DCM and note objections
about the project.."
We hope you, on behalf of the town, will see the necessity of the project.
