Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythat this project is consistentwith the North Carolina Coastal Management Program.

Dear Mr. Lane,
I am preparing to make repairs to the soil area behind my existing seawall/retaining
wall (Neuse River) due to damages caused by hurricane Isabel. The wall was
installed in early 2003; you should have documents to verify CAMA approval to
permit installation. Foley & Foley installed the wall for my lot, and at the same
time, the wall for the adjoining lot owned by Jerry Kirk, 106 Cypress Point. Jerry
Kirk also plans to repair the area behind his seawall.
Hurricane Isabel removed soil from behind my seawall for the full length of 100
feet. I intend to put down ground cloth, refill the lost soil behind the seawall and
top that soil with riprap. The area involved is about 8 feet wide, approximately 1-2
feet deep, for the 100-foot length. I also wish to place riprap in front of and up
against the seawall; out 4 feet, sloped back to a height of 4 feet.
I request your approval for the above described repair project. If you approve the
concept, I will get the necessary "Adjacent Riparian Property Owner Statement"
from each of my neighbors, if required, and forward them to you. Both neighbors
have verbally agreed to sign the statements.
