Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythatthis project is consistentwith the North Carolina Coastal Management Program.

(2) Confirmation that the adjacent riparian property owners have been
notified by certified mail of the proposed work. Such notice should
instruct adjacent property owners to provide any comments on the
proposed development in writing; for consideration by permitting; officials
to the Division of Coastal Management within 10 days of receipt of the
notice, and, indicate that no response will be interpreted as no objection.
DCM staff will review all comments and determine, based on their
relevance to the potential impacts of the proposed project, if the proposed
project can be approved by a General Permit. If DCM staff finds that the
comments are worthy of more in-depth review, the pplicant will be
notified that he must submit an application for a moor development
permit.

This correspondence is in reference to your July 20, 2005 objection letter to the riprap
project proposed by Mr. Glenn Bucklin at Lot 3, Saltayre, near Bayboro, on the Bay River,
Pamlico County, North Carolina. The applicants proposed to install 490' of riprap adjacent to
their property.
It appears that your objection centers on your concern regarding the potential for the rock
to deflect energy to your shoreline and increase the erosion along your shoreline. Hardening of
shorelines can present the potential for the deflection of energy; however, this potential is greatly
reduced by the installation of rock as opposed to a vertical wall. Because there is an existing
erosion escarpment on your property, we asked the applicant to reduce the length of the proposed
riprap by 15', to terminate 15' from your property line. Mr. Bucklin agreed to this modification,
and this was sufficient for the Division of Coastal Management (DCM) to issue a permit with the
reduced length of 475'.
Thus, the DCM reviewed the application along with the pertinent rules of the Coastal
Resources Commission in conjunction with your objections and determined that the project as
modified is consistent with the Commission's rules. Therefore, the DCM issued CAMA General
Permit #42416-C to Mr. Glenn Bucklin, with acting agent of Foley and Foley, on August 09,
2005 authorizing the riprap project.
If you wish to appeal this permit decision, you must file a Third Party Hearing Request
with the Director of the Division of Coastal Management, Mr. Charles S. Jones, Department of
Environment and Natural Resources within 20 days of the permit decision. A copy must also be
sent to the Attorney General's Office, Environmental Division. If you wish to appeal, please
contact me and I can forward you the pertinent forms. And if you have any questions about this
