Box 155 Swansboro, N.C. 28584 Re: Nellie Meadows Property — Jim McDaniel Offer To Purchase Dear Ms. Norris: Attached is my signed "Adjacent Riparian Property Owner Statement". Please note the special condition of approval. This should not create a problem in establishing a new pier and appears, based on my conversation with Mr. McDaniel, to.be the location of the proposed pier. Also attached is a plat of survey of my adjoining property. I made Mr. McDaniel aware that the current physical and legal access into the Meadows property are not contiguous. This has not been a problem and probably would not be unless I decided to place a fence on my property line. Long-term, anyone purchasing the Meadows tract would probably be better served to establish physical access within the 20 ft. legal access. I understand that Pate Phillips will survey the Meadows tract. The new survey should exhibit how the tract ties in to the easement. Sincerely, RV- Frank O. August 18, 2003 Located on the subject tract on the White Oak River are the remains of a pier that was in use for many years. As a condition of approval for the construction of a new pier, I request that the proposed pier enter the White Oak River at a point no further west than the site of the old pier. This should allow a functional location for the proposed pier and still maintain adequate separation between the proposed pier and the adjoining property to the west. Frank O.
