Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available information and belief, certifythat this project is consistent with the North Carolina Coastal Management Program. E. Blizzard, who owns the property at 147 Beechwood Drive, Pine Knoll Shores. The form was sent to me by certified mail, dated August 12, 2004. Mr. Blizzard and I have discussed the bulkhead repair work contained in this notification and he has stated that some dredging would be done, but the extent has not been explained to me. Since neither you nor I, per my telephone call to you on August 16, understand the drawing, I will not sign the notification until I have an opportunity to speak with him. Mr. Blizzard is a non- resident owner. Hopefully, he will be at the beach this weekend at which time I'll have him go over the drawing with me. I doubt there will be any problem, however, I do want to understand the dredging. I will call you and follow-up by sending the form to you as soon as Mr. Blizzard has reviewed the drawing with me. Delivery was attempted on 8/1.2/04 when I was out of the house. I was forced to go to the post office myself to pickup the notice and this I did August 19,2004. Mr. Blizzard has not reviewed his planned actions with me. I have also asked my son, Richard Seale, to help me in this matter. He left you a phone message earlier today. I want to be sure my rights are protected and hence this letter is being sent within the required time frame. I . .1 do not intend to waive my minimum 15 foot setback rights in any event. I have concerns as to how many and what boats Mr. Blizzard intends to moor and where. 2.
