Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available information and belief, certify that this project is consistent with the North Carolina Coastal Management Program. Davenport Division of Coastal Management Hestron Plaza 11, 151-B Hwy. 24 Morehead City, NC 28557 Dear Sir: February 6, 2005 z005 Morehead 01Y DOM This letter is in response to a request by Mr. Carl Heverly, contactor, to extend and enlarge the dock on the property neighboring ours. Our property is located at 5712 East Landing Court on Emerald Isle, NC and is co -owned by Francesco and Brenda Bruni and Michael and Deryl McGuire. The permit request is for the adjacent (eastern) property at 5710 E. Landing Court, owned by Mr Eric Angel. We have concerns about the proposed enlargement and would like to express them below. As described in Mr. Heverly's drawing of the proposed development, it is intended to lengthen the pier walkway 50 feet and add a 10' X 20' platform dock at the end of this extension. Additionally, there are plans to add a 12' boat lift on the east side and a jet ski lift behind the west side of the 20' wide platform. The drawing sent to us (copy enclosed) had the adjacent properties labeled in reverse of reality and an error in the shoreline frontage (75' versus less than 69' as stated on deed) making the relative distances between the proposed dock and our riparian access 21' rather than the 24'6". We do not wish to waive the 15' riparian setback requirement. The frontage error also puts the adjacent property on its East side to be just at the 15 foot riparian limit. There is less concern on our part, over the size of the platform and the lifts, than the distance of 50 feet extension as proposed. The properties in `Bell's Cove", as we call it, are indeed in an indention alone the coastline with our property and that of Mr. Angel's occupying the deepest part of the curve. The proposed distance of the extension would cut off easy access from the east to our much shorter pier. It is noteworthy to mention that when we improved our dock, extending was not an option because it would have outdistanced our neighbors and created the same undesirable situation being proposed. We propose an alternative that would allow the Angels to improve access for their boats and increase their property benefits while neither adversely impacting our access nor the value of our property benefits. We propose that the extension of the walkway be reduced from 50 feet to a more desirable 35 feet and then add the 10'X20' platform. This is an increase in overall length of 45 feet rather than the proposed 60 feet. This maintains his desire to get closer to the channel and have easier access for his boat and jet skies while having less negative impact on our access. Enclosed please find the aerial maps, of the properties, on which we visualized the possible impacts and thus submit our proposal.
