violation of these terms may subject the permittee to a fine,
imprisonment or civil action; and may cause the permit to be-
come null and void.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
adjacent riparian landowners certifying that they have no
objections to the proposed work.
In issuing this permit the State of North Carolina certifies that
this project is consistent with the North Carolina Coastal
Management Program.

SUBJECT: Randy Hoft General Permit # 22331-C
DATE: June 4, 1999
Reference is made to the issuance of General Permit (GP) # 22331-C issued to Mr.
Randy Hoft at 114 Pond Drive on 'The Pond', in the Town of Atlantic Beach, Carteret
County.
Mr. Hoft had contacted me several weeks ago concerning the installation of a boat lift
on the east side of the above mentioned property. I told him we would need the signed
riparian statements from the adjoining property owners indicating they had no objection
to the project and if the boat lift was to encroach within the 15' setback that we would
need the 15' waiver signed also. Ms Peggy Stokes, riparian neighbor to the east
contacted me and questioned her riparian rights and she felt like the boat lift would be
less than 15' from her riparian property line.
On May 24, 1999, 1 made a site visit to the above property. Mr. Robert Johnson,
Marine Contractor was scheduled to meet with me but never showed up. I met with
Ms. Peggy Stokes. She said she had concerns about the placement of the boat lift
next to her property and she was not going to waive the 15' setback.
I contacted Mr. Hoft and relayed this information to him. Mr. Hoft contacted Mr. Steve
Powers, with Atlantic Coast Professional Surveying. Mr, Powers established the
riparian line by coming from the center of the pond to the NHW line. 'The line of
division of areas of riparian access shall be established by drawing a line along the
channel or deep water in front of the property, then drawing a line perpendicular to the
line of the channel so that it intersects with the shore at the point the upland property
meets the water s edge'.
On May 28, 1999 1 made another site visit to the property but Mr. Powers had not
flagged the property lines.
On June 2, 1999 1 met on the property with Mr. Hoft owner, Ms. Peggy Stokes, riparian
neighbor, to the east, Mr. Hassell friend of Ms. Stokes, and Mr. Robert Johnson,
marine contractor. I explained to all present the meaning of riparian property lines and
that Mr. Powers's survey was not correct. Mr. Hassell kept insisting that he felt like the
boat lift was encroaching on Ms. stokes property. Mr. Hoft reminded Ms. Stokes that

he had an additional 15' of lot # 28. We then placed PVC pipe in the water to
determine the exact location of the proposed boat lift. Ms Stokes said she had no
problem with the proposed location and would waive the 15' setback. She signed the
no objection form and waived the 15' setback. Mr. Hoft said he needed to get the
other neighbor's signature. I told him I would write the permit and Mr. Johnson could
pick it up on June 3, 1999 at my office.
On June 3, 1999 1 issued GP # 22331-C to Mr. Randy Hoft to install a boat lift on his
property. Before Mr Johnson could pick up the permit Mr. Hassell came by without an
appointment, to discuss the situation with Mr. Ted Tyndall, District Manager. Mr.
Hassell did not feel the issuance of the permit was moral. Mr. Tyndall and I informed
him that any correspondence should come through Ms. Stokes and not him. We told
him that we would hold the releasing of the permit until Mr. Tyndall and I could make
a site visit. I contacted all the parties involved and set up a meeting for 10:00 A.M. on
June 4, 1999 at Mr. Hoft's property.
On June 3, 1999 Ms. Stokes called Mr. Tyndall and requested we cancel the meeting
until she could seek legal advice. On June 4, 1999 Ms. Stokes called this office and
left a message that she had decided to allow the boat lift to be installed as we had
discussed earlier. On June 4, 1999 I, called Ms Stokes and discussed the matter with
her again. Ms. Stokes said she had no problem with the location of the proposed boat
lift as we had determined in the field on June 3, 1999 and she still wished to waive the
15' setback. I called Mr. Hoft and left a message that the permit was ready and Mr.
Johnson could pick it up. I also called Mr. Johnson and left a message with his
secretary and told her the permit was ready and Mr. Johnson could begin work once
he picked up the permit and obtained a building permit from the Town of Atlantic
Beach Building Inspections office.
