Attached you will find AtucentRiparkni Property C4vner Statement, a standard form used
routinely to obtain sign -off from adjacent property owners in order to put in bulkheading and/or to
construct a dock. The drawing of the development which we propose is included on the form.
Since there is extensive erosion along the water's edge, it is essential that we install bulk -heading in
the form of riprap [large rocks underlaid with netting and smaller rock] to allow for the water to
circulate, but no longer to erode the shoreline and cause us to lose more trees. On Thursday,
October 22nd we obtained permission from CAMA to proceed with this installation, and hereby
request your signature as a neighbor.
Additionally we propose to build a simple fifty to sixty foot dock, depending upon water
depth in the creek, for our Carver 250, a 25-foot power boat, which requires 3-1/2 feet of water.
As you may note, we have observed the new law which requires dock construction to begin a
.minimum of 15 feet from adjacent properties. The plan is outlined on the form attached.

This letter is in reference to the Notice of Violation sent to you on December 11, 1998 that was
returned undeliverable but subsequently hand -delivered to you on January 9, 1999, for unauthorized
development. The violation took place at your property located on lot #11, in Osprey Point
Subdivision, adjacent to Ball Creek, in the Community of Merritt, Pamlico County. The violation
involved the unauthorized placement of 100 feet of rock rip rap within the Estuarine Shoreline,
Estuarine waters and Public Trust Waters of Ball Creek, all of which are Areas of Environmental
Concern designated by the Coastal Resources Commission. No restoration was requested by the NC
Division of Coastal Management.
The Coastal Area Management Act provides that a civil assessment of up to $2500.00 may be
assessed for any violation. It is the policy of the Coastal Resources Commission to assess a civil
penalty for all violations. This is done to recover some of the costs of investigating violations and/or
to compensate the public for any damage to its natural resources.
Under Coastal Resource Commission rules, a civil penalty in the amount of $150 is appropriate for
this violation. You have chosen to expeditiously resolve the matter, and have accepted
responsibility for the violation, waived your right to an administrative hearing, and paid the amount
proposed above. I am enclosing a copy of the "Waiver of Right to Administrative Hearing and
Agreement to Pay Civil Assessment" that you signed last week. Also, I have forwarded a copy of
the Waiver and your check to the Department's Office of General Council which will in turn notify
you of your compliance and the closure of this enforcement action.
