This permit is subject to compliance with this application, site
drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine,
imprisonment or civil action; and may cause the permit to be-
come null and void.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
adjacent riparian landowners certifying that they have no
objections to the proposed work.
In issuing this permit the State of North Carolina certifies that
this project is consistent with the North Carolina Coastal
Management Program.

Brandywine Marina Association, Inc. (BMA) wishes to hire Bentley Brooks Dredging (BBD) to
perform maintenance dredging of BMA's marina entrance channel as shown on the diagram
attached to this contract. BBD will remove approximately 166 cubic yards from Section B and
approximately 583 cubic yards from Section A (or 749 total yards). Section B will be dredged
to a maximum depth of 6 feet below mean low water and Section A will be dredged to an
approximate depth of 5 feet. Please indicate your agreement to the terms of this letter by signing
below.
The material removed will be transported to the spoil area shown on the diagram attached and
will be piled up for drying behind a silt fence provided by BBD. The material will then be
hauled off to an appropriate spoil disposal site by equipment hired by BBD. BMA will be
responsible for the cost of silt fencing and the movement of material within the spoil area.
BMA will pay BBD $12.00 per cubic yard for material removed and placed in the spoil area. It
is agreed that each barge load of material will equal 25 cubic yards. BBD will keep BMA
apprised of progress in the two areas as the work proceeds. The work will take between 5 and 7
working days. BMA will also pay BBD the sum of $ for hauling and disposal of
spoils.
BMA will pay BBD $1000 upon commencement of the work with the balance due on
completion. BMA will have the right to confirm the depths and dimensions of the work before
final payment is due.
All dredging and spoils deposit will be done in accordance with CAMA regulations as specified
in the attached. Commencement of the work will be dependent upon the issuance of a General
Maintenance Permit by CAMA. Work will be completed no later than April 30, 1999.
BBD will maintain a general liability insurance policy covering personal injury or death and
property damage on the premises in a minimum amount of $500,000. BBD will not be
responsible for any damage caused by equipment or performance of third parties not hired by
BBD. Any damage to bulkheads, channel markers, or other property of BMA or others will be
the responsibility of BBD.
