This permit is subject to compliance with this application, site
drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine;
imprisonment or civil action; and may cause the permit to be-
come null and void.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
adjacent riparian landowners certifying that they have no
objections to the proposed work.

I, Dan Foley, acknowledge the receipt of payment in full in
the amount of $1,000.00 from Joel Williams. This payment is full
and final payment for the construction of a boathouse lift and
dock which was constructed at 803 Lake Point Road, New Bern,
North Carolina, the residence of Joel and Deanna Williams.
I, Dan Foley, was present at the signing of the initial
agreement by A.J. Ballard, agreeing that we, Foley & Foley
Construction Company, could construct the boathouse lift and dock
pursuant to blueprints submitted to Cameron, as well as Core of
Engineers and all other interested parties, to get the approval
and to begin the proper waiting period before the construction of
the project. Upon the signing of this initial agreement, Mr.
Ballard agreed that'he had no objection to the project. However,
when he saw the blueprints, he informed us that if we could
relocate the dock, he would pay the expense of said relocation,
which was approximately $1,000.00. Pursuant to this relocation,
Joel Williams and A.J. Ballard entered into a "gentlemen's
agreement" whereby A.J. Ballard told Foley & Foley Contracting
Company to bill him directly at his place of employment, and he
would take care of paying the $1,000.00. I, Dan Foley, saw Mr.
Ballard sign the agreement, and it was submitted and kept on
record. Mr. Ballard was willing to pay this amount of $1,000.00
toward the total construction of the project, providing it would
be relocated to the far side of the bulkhead of the Williams'
residence.
This was done as requested by Mr. Ballard; however, he
reneged on the agreement, saying that he did not approve of the
appearance of the -project after it was constructed, and therefore
refused to pay the $1,000.00. Joel Williams, being an honorable
man, agreed to pay me so that I would not be left without the
final payment. All construction of the project was done in a
proper manner and had approval of all involved parties. I, Dan
Foley, find that all monies have been paid, the construction is
completed, and Foley & Foley,aC'ontracting Company is satisfied.
