In a recent attempt to allay a neighbor's valid concerns over runoff increased by adjoining development, we were reminded by the Attorney General's Office that the Coastal Area Management Act does not address stormwater, and the Division does not regulate it. I do not have any questions concerning the construction of the tower itself. My concern is the landscape buffer which is going to be placed along adjoining property lines. I would like to be assured that any buffers put in place will provide for adequate drainage on said property and will not create any standing water problems on my property. F&R IS TO OBSERVE AND APPROVE THE SHAFT DRILLING AND CONCRETE PLACEMENT. CONTRACTOR SHALL PROVIDE ADEQUATE ASSISTANCE AND PRIOR NOTIFICATION TO ACCOMPLISH THIS REQUIREMENT. v UM TIE BAR 30" ftI:yy,' Alton L. Hall 6301 Market Street Wilmington, NC 28405 Dear Mr. Hall, NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES DIVISION OF COASTAL MANAGEMENT U October 1, 1998 I am writing to you with regard to your concerns over the cell communication tower to be constructed on Cedar Pt. Blvd. in Carteret County. You expressed a concern over potential stormwater runoff potential from the proposed vegetated buffer. The Division of Coastal Management does not manage stormwater runoff. In a recent attempt to allay a neighbor's valid concerns over runoff increased by adjoining development, we were reminded by the Attorney General's Office that the Coastal Area Management Act does not address stormwater, and the Division does not regulate it. Stormwater is regulated by the Division of Water Quality out of the Wilmington Regional Office. However, there rules are not initiated unless there is an acre of disturbance, which there is not, or a CAMA Major Permit required, which there is not. You may want to contact the Zoning Office of Carteret County, as they are requiring the vegetated buffer. I will advise the American Tower Systems of your concerns as well. Thank you for your comments, and I apologize that I cannot address this issue further. If you have any questions, please feel free to call me. Sincerely, T.
