The proposed project to be located and constructed as described
above is hereby certified as exempt from the CAMA permit re-
quirement pursuant to 15 NCAC 7K .0203. This exemption to
CAMA permit requirements does not alleviate the necessity of
your obtaining any other State, Federal, or Local authorization.
This certification of exemption from requiring a CAMA permit is
valid for 90 days from the date of issuance. Following expiration,
a re-examination of the project and project site may be necessary
to continue this certification.

Any person who proceeds with a development without the con-
sent of a CAMA official under the mistaken assumption that the
development is exempted, will be in violation of the CAMA if there
is a subsequent determination that a permit was required for the
development.
The applicant certifies by signing this exemption that (1) the ap-
plicant has read and will abide by the conditions of this exemp-
tion, and (2) a written statement has been obtained from adjacent
landowners certifying that they have no objections to the
proposed work.

This is to follow up on our telephone conversation of several weeks ago. As I
understand it, Salter Path Fisheries would like to rebuild the structure the State allowed to be
placed on Dog Island under a lease arrangement many years ago. I understand that the
structure has been damaged by hurricanes Fran and Bertha and that you need a letter of
authorization from this office in order to obtain a CAMA Permit to rebuild.
Please consider this letter authorization to proceed with reconstruction of the
improvement subject to any permit or further approval required by the Division of Coastal
Management. The reconstruction of the improvement must not exceed the original footprint
in size and can not be located over water or wetlands.
As we discussed by telephone, we need to address the renewal of your lease with the
State. In this regard, you should reactivate your association (Salter Path Fisheries) as a not -
for -profit organization and apply to this office in writing for permission to renew the lease.
Approval of the lease will require review by the Joint Legislative Commission on
Governmental Operations and the Council of State.
