Howes, Secretary February 7, 1997 CERTIFIED MAIL P 455 551 309 RETURN RECEIPT REQUESTED Ms. Margaret Liles 2017 St. Mary's Street Raleigh, NC 27608 Dear Ms. Liles: FEB 1 1 1997 Thank you for your comments on February 6, 1997 concerning the proposed development adjacent to your property proposed by Charles Smith at 7193 Inland View Plaza in Ocean Isle Beach, NC. Unfortunately, as of this date, I have not received your written objections. The project consists of the construction of a bulkhead to stabilize the shoreline of the property. The project is consistent with our regulation (T15A:07H.1100 copy enclosed) which authorizes a General Permit for the construction of bulkheads and the placement of riprap for shoreline protection in estuarine and public trust waters. A condition of the permit states "Bulkheads must be positioned so as not to exceed more than an average distance of 2 feet waterward of the mean high water mark, or the normal level contour, whichever is applicable. In no case shall the bulkhead be positioned more than five feet waterward of the mean high water or normal water level contour at any point along its alignment". In cases where there are existing bulkheads, the bulkhead itself denotes mean high water. As such, a permit has been issued to authorize the project. Since you wish to appeal this decision to the Coastal Resource Commission, I have enclosed the appropriate forms. A third -party appeal must be filed within 20 days of the issuance of the permit.
