The purpose of my site visit was to address the extent of damage to the existing sandbags which protect the townhomes. From my site inspection, it appears that Hurricane Bonnie has caused some damage to the existing sandbags. As you recall, these sandbags were permitted as temporary erosion control structures and may remain in place for up to five years after the permitted date of January 16, 1997. Our rules do allow for existing sandbag structures to be maintained provided that the permitted dimensions are not exceeded. Based on General Permit #016955, approximately 195' of sandbags were installed along the erosion escarpment in front of the townhomes. Therefore, as long as the sandbags are tan in color and the base of the structure does not exceed 20' and the height does not exceed six feet, you are hereby authorized to repair the sandbag structure, which may include replacing damaged bags. As I also stated during our meeting, extending the footprint of the sandbags can not be authorized by the Division. Based on NCAC 07H.0307(a)(2)(L)&(M) construction of a temporary erosion construction shall be approved only once on a property regardless of ownership. Since there were several different scenarios discussed, I thought it would be best to summarize our discussion. Since the swimming pool will be located within the erosion setback area, the concrete apron around the pool is limited to 6' in width. It is my understanding that this is the minimum required by Health Department rules. It was also brought out that Health Department regulations requires a pump house to be attached to the pool. This pump house may be no larger than the minimum required by Health rules. Wooden decks around the pool and within the setback may be permitted as long as they do not exceed a cumulative size of 500 square feet. The walkway must not exceed 6' in width. Piling depth of the walkways may not exceed a depth of 5' or the minimum depth required by the NC State Building Code. The area between the swimming pool/deck area may be filled with sand or similar material for the purpose of being used as a grassed lawn area. The existing concrete block retaining walls must, however, be removed. Some wooden landscaping timbers can be used to stabilize the slope of the lawn/fill area but detailed plans must be submitted and approved prior to their installation.
