Any violation of these terms may subject the permittee to a fine, imprisonment or civil action; and may cause the permit to be- come null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) this pro- ject is consistent with the local land use plan and all local ordinances, and 2) a written statement has been obtained from adjacent riparian landowners certifying that they have no objections to the proposed work. In issuing this permit the State of North Carolina certifies that this project is consistent with the North Carolina Coastal Management Program. Box 2822 Atlantic Beach, NC 28512 Dear Mr. Grady: This letter confirms our meeting of October 19, 1999 onsite property at Pine Knoll Towne II off NC 58, adjacent to the Atlantic Ocean, in Pine Knoll Shores, Carteret County. The purpose of my site visit was to address the extent of damage to the existing sandbags which protect the townhomes and the requirements for repair/replacement of the bags. From my site inspection, it appears that Hurricane Floyd caused severe damage to the existing sandbags. As you recall, these sandbags were permitted as temporary erosion control structures and may remain in place for up to five years after the permitted date of December 9, 1999. Our rules currently allow for existing sandbag structures to be maintained provided that the permitted dimensions are not exceeded. Based on General Permit #016971-C, approximately 220' of sandbags were permitted and subsequently installed along the erosion escarpment in front of the townhomes. Therefore, as long as the sandbags are tan in color and their repair/replacement is within the originally permitted dimensions, you are hereby authorized to repair the sandbag structure. Again, the repaired sandbags may remain in place for up to five years after the date of original approval unless of course they are covered with sand and natural vegetation.
