The proposed project to be located and constructed as described
above is hereby certified as exempt from the CAMA permit re-
quirement pursuant to 15 NCAC 7K .0203. This exemption to
CAMA permit requirements does not alleviate the necessity of
your obtaining any other State, Federal, or Local authorization.
This certification of exemption from requiring a CAMA permit is
valid for 90 days from the date of issuance. Following expiration,
a re-examination of the project and project site may be necessary
to continue this certification.

Any person who proceeds with a development without the con-
sent of a CAMA official under the mistaken assumption that the
development is exempted, will be in violation of the CAMA if there
is a subsequent determination that a permit was required for the
development.
The applicant certifies by signing this exemption that (1) the ap-
plicant has read and will abide by the conditions of this exemp-
tion, and (2) a written statement has been obtained from adjacent
landowners certifying that they have no objections to the
proposed work.

we have received your proposal for development_ regUlated by the Coastal
Area Management Aot (CAPIA). The activity you propose is exempt from
needing a (Minor Development Permit as long as it meats the conditions
specified below. If your Plans should change and your project will no
longer meet these conditions, please contact me before proceeding-
Piers- (7K.4243)-A private, non-commercial pier may he constructed if it
does not exceed 200' in total length offshore, is not within 150' of a
federally maintained channel; does not extend beyond the 4' mean low water
line or normal water level, (whichever is applicable) of the watorbody:
does not exceed b' in width: does not ,include an enclosed structure; and,
does not interfere with established navigation rights. The 4' mean low
water restriction shall not apply to piers constructed on man made canals
and basins_ It may be built through wetland vegetation only if elevated
and may have a T-head or platform not exceeding 500 5F in area at its
waterward end if no wetland areas are covered. The pier must be set back
15' from the adjacent property owners area of riparian access unless
waived by a written agreement. Conformation must also be given that
written statements have been obtained from adjacent riparian property
owners indicating that they have no objections to the proposed pier.
Also, piers authorized by this exemption shall be fpr private
use only.

Dear Mr. Parker,
I am writing to you with regard to the inspection I made of your bulkhead, rip rap, pier, and
dock on July, 16, 1998. The inspection was generated by a complaint of possible non-
compliance with the regulations governing such structures. I found that you had obtained
permits for all of the development, and had constructed that development within the
constraints of those permits, with one exception. The required 15' setback from the adjacent
riparian corridors appeared to be breached on the Town of Bridgeton side of the property.
As your CAMA Exemption stated, this 15' setback must be honored unless the adjacent
property owner waives the setback. There is no evidence that a waiver had been obtained.
Today, July 27, I received a waiver of that setback from Michael Whaley, Mayor of the Town
of Bridgeton. With this letter, I can now conclude that you are in compliance with your
permits and the regulations governing bulkheads, rip rap, and piers and docks. I appreciate
your cooperation in this matter. If you have any questions, please feel free to call me.

This letter is in reference to a complaint lodged against Mr. Ray Parker, 717 A Street,
Bridgeton, conccu�ing a vioUtion of a 15' tiparian access on the Town of Btidgeton's property
located at the west end of Washington Street.
By unx3 mous vote of the Board of Commimioners, we wish for you to accept this ictter as the
Town of Bridgeton's written statement agreeing to waive the requirement that the pier must be
set back 15' from the property owner's area of riparian access. The Town has no problem with
Mr. Parker's exiatirng pier, deck or seawall.
If we can be of any finiher assistance, please do not hesitate to call. We appreciate your dime
and effon with this matter.
