This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal, or Local authorization. This ccrtification of exemption from requiring a CAMA permit is valid for 90 days from the date of issuance. Following expiration, a re-examination of the project and project site may be necessary to continue this certification. SKETCH (SCALE: } G0It Any person who proceeds with a development without the con- sent of a CAMA official under the mistaken assumption that the development is exempted, will be in violation of the CAMA if there is a subsequent determination that a permit was required for the development. Box 214 Swansboro, NC 28584 Dear Mr. Phillips, At 9 A4 NCDENR ENVIRONMENT AND NATURAL REs JRCES January 5, 1998 I am writing to you with regard to the CAMA Minor Permit you applied for and received in the name of Eastern Omni Constructors, Inc., for development of 9707 Dolphin Ridge Road in Emerald Isle. Specifically, this was CAMA Permit # 195. This permit was issued for the grading and filling of said lot within the development of Dolphin Ridge. Proposals for all the similar activity within this development have been evaluated cumulatively by Dan Sams of the N. C. Division of Land Quality for compliance with the NC Sedimentation Pollution Control Act. It is the determination of Mr. Sams that the above mentioned proposal requires a sedimentation/erosion control plan approved through his office. In accordance with NC General Statutes 113A-118, a CAMA Major Permit shall be required when "any development requires permission, licensing, approval, certification or authorization in any form from ...... the North Carolina Sedimentation Control Board...." As such, the CAMA Minor Permit process is not available for the work proposed in the above mentioned application and permit. Consequently, state permit # 195 is hereby deemed NULL AND VOID. Any activity conducted based on this permit must CEASE AND DESIST. The CAMA Major Permit process is available for this type of development, and I am enclosing the appropriate application.
