This exemption to LAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal, or Local authorization. This certification of exemption from requiring a CAMA permit is valid for 90 days from the date of issuance. Following expiration, a re-examination of the project and project site may be necessary to continue this certification. This permit, issued on 27 , is subject to compliance with the application (where consistent with the permit), all applica le regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. Excavation (1) In order to minimize environmental impacts in Everett's Creek, the width of the channel shall be limited to 40' top width and the depth shall be limited to -4' MLW. (2) In order to protect juvenile shrimp and fin fish populations, no excavation or filling will be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal Management. (3) No marsh grass will be excavated and/or filled. (4) The diked disposal area will be constructed a sufficient distance from the mean high water level of any marsh to eliminate the possibility of dike erosion into or upon any marsh and/or surrounding waters. (5) If the disposal area nearest the wastewater disposal area is to be used, (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1989 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. NOTE: Some mosquito problems may result from spoil disposal areas and from the surrounding salt marsh. For information concerning appropriate mosquito control measures, the applicant should contact the Vector Control 'Branch at (919) 733-6407. NOTE: The proposed project is certified under General Water Quality Certification No. 1273 issued on November 10, 1978, for discharges of liquid effluent from diked upland disposal areas. Stormwater Management (11) The stormwater plan described on the attached plat must be adhered to in all phases of construction. Boat Docks (12) All docks and piers shall be limited to a 6' width. (13) The dock's T-head portion of pier system cannot be located over marsh but must be located over open water. t (14) The � dock system, includingan tie Y piles, must not extend waterward more than one-third the width of the creek as measured from shoreline to shoreline. To comply with this requirement, "parallel docking" may be necessary. 3 (15) Overboard sewage discharge is prohibited at dockside under this permit. NOTE: In keeping with his verbal commitment to the Division of Environmental y Management, the permittee should prohibit the use of dock system by boats < i equipped with marine heads. s �
