This permit, issued on �/ is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) This 8/88 modification authorizes riprap placement no farther waterward
than 5 feet from MLW at any point along its alignment.
(2) All work will be accomplished in strict accordance with the permit drawings.
(3) The riprap material will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials, or unsightly debris
will not be used.
(4) No fill material other than the authorized riprap, as noted by conditions
1-3, will be placed at any time in any vegetated wetlands or waters of
the state.
(5) The activity will be conducted in such a manner as to prevent significant
increases in turbidity outside the area of construction or construction -
related discharge.
(See attached sheet for Additional Conditions
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the cafe may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1991
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

(6) The permittee will maintain the authorized work in good condition and in
conformance with the terms and conditions of this permit. The permittee
is not relieved of this requirement if he abandons the project without
having the permit transferred to a third party.
(7) It is possible that the authorized structure may be damaged by wavewash
from passing vessels. The issuance of this permit does not relieve the
permittee from taking proper steps to ensure the integrity of the permitted
structure and the safety of moored boats.
(8) This permit does not authorize the interference with any existing or proposed
Federal project, and the permittee will not be entitled to compensation
for damage or injury to the authorized structure or work which may be caused
from operations undertaken by the United States in the public interest.
(9) If the display of lights and signals on the authorized structure is not
otherwise provided for by law, such lights and signals as may be prescribed
by the U.S. Coast Guard will be installed and maintained by, and at the
expense of the permittee.
NOTE: Section 401 Water Quality Certification #2257 was issued for the riprap
placement on July 28, 1988 by the Division of Environmental Management.

Dear Mr. Hassinger:
Reference your request for modification to your State/Federal
authorization which authorized construction of a pier with gazebo
and boardwalk, bulkhead repair and installation of pilings on
Taylors Creek, Beaufort, Carteret County, North Carolina. You
asked for authorization to repair r1prap material immediately
waterward of your bulkhead.
Your proposed modification has been reviewed and found to be
consistent with the provisions and objectives of general permit
No. SAWC080-N-000-0291. Therefore, you may commence construction
activity in strict accordance with the modified State
authorization and the enclosed plan. Failure to comply with the
State authorization or conditions of the general permit could
result in a violation of Federal law.
If any additional change in your work is required because of
unforeseen or altered conditions or for any other reason, plans
revised to show the change must be sent promptly to this office
and the North Carolina Division of Coastal Management prior to
performing any such change or alteration. Such action is
necessary as revised plans must be reviewed and the authorization
modified.

9. NARRATIVE DESCRIPTION: Applicant's property is located at
1524 Front Street, in Beaufort, Carteret County, on Taylors
Creek. Applicant recently received Major Permit #42-88 on
February 24, 1988 for construction of a dock and repair to
bulkhead. The new proposed project is to add approximately
50 cu. yds. of #57 & #67 marl rock for protecting the
existing seawall. The proposed riprap will extend an
average of 5' waterward along 901of the existing seawall.
10. ANTICIPATED IMPACTS: The proposed riprap will cover
approximately 450 sq. ft. of estuarine waters in Taylors
Creek. Taylors Creek is classified as 'SC' by the Division
of Environmental Management and is closed to shellfishing by
the Division of Health Services.

Reference the May 16, 1988, request of Mr. Stanley
Hassinger, Jr., for a modification to his State/Federal permit
which authorized construction of a pier with gazebo and boardwalk,
installation of pilings and bulkhead repair on Taylors Creek,
Beaufort, Carteret County, North Carolina. The modification would
authorize repair of riprap material immediately waterward of the
bulkhead.
We recommend that the following conditions be included in the
State modified authorization:
a. The riprap material will not be positioned farther
waterward than 5 feet from the mean high water (MHW) elevation
contour at any point along its alignment.
b. The riprap material will be clean and free of any
pollutants except in trace quantities. Metal products, organic
materials, or unsightly debris will not be used.
c. The activity will be conducted in such a manner as to
prevent a significant increase in turbidity outside the area of
co-.5tru(,.L .on or construct [on -related discharge. Increases Such
that the turbidity in the waterbody is 50 NTU's or less are not
considered significant.

APPLICATION FOR CAMA MAJOR DEVELOPMENT
PERMIT AND WATER QUALITY CERTIFICATION
The Department of Natural Resources and Community
Development hereby gives public notice as required by NCGS
113A -119(b) and 143-215 3(a)(1)(c) that Stanley Hassinger, Jr.,
of Carteret County, filed an application on May 25, 1988, for a
permit from the Division of Coastal Management to develop in an
Area of Environmental Concern and for certification from the
Division of Environmental Management that a discharge of fill
material in project wetlands will not violate applicable water
quality standards.
According to said application, the applicant proposes to
place riprap waterward of an existing seawall at 1524 Front
Street, on Taylors Creek, in Beaufort, Carteret County.
A copy of the entire application and additional information
may be examined (or copies furnished upon request and payment of
reproduction costs) during normal business hours at the office of
David Noble, Division of Coastal Management, located in the
Division of Marine Fisheries Building, Morehead City, N.C.,
919/726-7021, and/or the office of Preston Howard, Division of
Environmental Management, NRCD Regional Field Office, Wilmington,
N.C., 919/256-4161.
The Division of Environmental Management proposes to take
final action on this water quality certification on or before
July 24, 1988. The issuance of the CAMA Major Development permit
and the Section 401 Certification may deviate from this projected
date depending upon the nature of the comments submitted and
subsequent hearings that may result.
All persons desiring to make comments should do so in
writing to Mr. David Owens, Director, Division of Coastal
Management, P.O. Box 27687, Raleigh, N.C., 27611, prior to
July 14, 1988 for consideration in the CAMA permit decision, and

9. NARRATIVE DESCRIPTION: The applicant's proposed project is
located at 1524 Front Street, on Taylors Creek, in Beaufort,
Carteret County, N.C. The proposed project is a 8' x 68'
pier, a 16' x 41' deck, and a 8' x 3' finger pier. also
included in the project is a 6' x 41' deck. Six (6) tie
pilings are proposed in conjunction with the pier. A
proposed 16' x 16' gazebo is to be located on the 16' x 41'
deck which is also included in the application. In addition
to the proposed pier, the applicant proposes to repair an
existing 90' bulkhead. The repair will consist primarily of
placing additional rock and a filter cloth landward of the
existing riprap.
A major permit is needed for this project due to its
proximity to a federally maintained channel.
10. ANTICIPATED IMPACTS: The pier and docks will result in the
covering of 1440 sq. ft. of public trust waters. The
maximum distance the pier will extend waterward from the
bulkhead is 681.
The waters of Taylors Creek at the project site are
designated "SC" by the Division of Environmental Management
and are closed to shellfishing by the Division of Health
Services.

A copy of the deed (with state application only) or
other instrument under which the applicant claims
title to the affected property. If the applicant is not
claiming to be the owner of said property, then for-
ward a copy of the deed or other instrument under
which the owner claims title, plus written permis-
sion from the owner to carry out the project.
An accurate work plat (including plan view and
cross sectional drawings) drawn to scale in black
ink on 8 t/2 x 11 white paper. (Refer to Coastal
Resources Commission Rule 7J.0203 for a detailed

Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.

This permit, issued on JANUARY 5, 1995 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be
subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
1) This permit authorizes only the docks, piers, and other structures and uses located in or over
the water that are expressly and specifically set forth in the permit application. No other
structures, whether floating or stationary, may become a permanent part of this docking facility
without permit modification. No non -water dependent uses of structures may be conducted on,
in, or over public trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation
of this permit for which the permittee is responsible. This prohibition shall be applied and
enforced throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31. 1998
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

Mr. Oakley's property is located at 1524 Front Street and on
Taylor's Creek in the Town of Beaufort in Carteret County. He
proposes to enlarge an existing pier structure and construct a boat
lift.
AECs impacted by the project include Estuarine Waters and Public
Trust Areas. Waters at the project site are classified as SC and
are closed to the harvesting of shellfish. The area is not a
Primary Nursery Area.
I have reviewed this project for consistency with the 1990 Town of
Beaufort Land Use Plan (LUP) Update and offer the following
comments.
The general area of the project is classified as Developed, while
the AECs impacted by the proposal are classified as Conservation.
The Town's policies for development in Conservation classified AECs
are summarized on Page V-2. The Plan states that "Development in
the estuarine system should be restricted to uses which satisfy 15A
NCAC 7H Use Standards. Except for policies opposing the location of
floating structures within Beaufort's planning jurisdiction, the
Conservation class policies and standards included in this Plan are
not more restrictive than the 15A NCAC 7H Use Standards."
Provided this project can be permitted in accordance with the 7H
Use Standards, this activity is consistent with the 1990 Beaufort
LUP.

9. NARRATIVE DESCRIPTION: The applicant's property is located at 1524 Front
Street, in the Town of Beaufort, Carteret County. The property is bordered on the
north by Front Street and to the south by Taylor Creek. A single-family residence has
been constructed on the property and is now in the process of being remodelled.
CAMA Permit 42-88 was issued to the previous land owner and authorized the
construction of a large pier, finger piers and associated tie off pilings. This permit was
later modified to include the placement of riprap along the shoreline waterward an
existing bulkhead. All permitted development has been completed.
The new land owner now proposes to add a 30' long x 6' wide floating pier just east
and parallel to the existing main pier. In order to gain access to this structure, a 16'
long x 4' wide access ramp is proposed to connect the main "fixed" dock with an
approx. 18' long x 4 to 8' wide landing area which will also be floating. A boat lift,
approx. 13' long x 13' wide, is proposed to be located within an existing boatslip on
the west side of the main pier. Two catwalks, approx. 9' long x up to 5' wide would
provide access to the boat lift. The waters at the project site are classified as SC by
the Environmental Management Commission and are closed to the harvesting of
shellfishing. Water depths are approx. -10' mean low water deep at the location of the
additions.
10. ANTICIPATED IMPACTS: The applicant proposes to construct several additions to
an existing pier structure in Taylor Creek. These modifications would result in
approx. 631 sq. ft. of additional public trust areas being "shaded" by these structures.
The total "shaded" area of all the existing and proposed structures is approx. 5,000 sq.
ft.. The neighbor to the east has waived the 15' riparian setback requirement. The
boat lift on the west side of the project would be at least 15' from the riparian property
line. The structure(s) will not extend any farther out into Taylor Creek than the
existing dock and tie -off pilings.

examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.
