(1) This 8/88 modification authorizes riprap placement no farther waterward than 5 feet from MLW at any point along its alignment. (2) All work will be accomplished in strict accordance with the permit drawings. (3) The riprap material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. (4) No fill material other than the authorized riprap, as noted by conditions 1-3, will be placed at any time in any vegetated wetlands or waters of the state. (5) The activity will be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction - related discharge. (See attached sheet for Additional Conditions This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the cafe may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. It was received on May 25, 1988, and appears to be adequate for processing at this time. The projected deadline for making a decision is August 8, 1988. An additional 75 -day review period may be necessary and if so you will be advised of the extension and the new deadline. NCGS 113A -119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your property; or at a point along the road right-of-way where a private road would lead one into your property. Failure to post this notice could result in an incomplete application. An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate P.O. NARRATIVE DESCRIPTION: The applicant's proposed project is located at 1524 Front Street, on Taylors Creek, in Beaufort, Carteret County, N.C. The proposed project is a 8' x 68' pier, a 16' x 41' deck, and a 8' x 3' finger pier. also included in the project is a 6' x 41' deck. Six (6) tie pilings are proposed in conjunction with the pier. A proposed 16' x 16' gazebo is to be located on the 16' x 41' deck which is also included in the application. In addition to the proposed pier, the applicant proposes to repair an existing 90' bulkhead. The repair will consist primarily of placing additional rock and a filter cloth landward of the existing riprap. A major permit is needed for this project due to its proximity to a federally maintained channel. 10. ANTICIPATED IMPACTS: The pier and docks will result in the covering of 1440 sq. ft. of public trust waters. The maximum distance the pier will extend waterward from the bulkhead is 681. FIELD INVESTIGATION REPORT: Max Oakley\Carteret PAGE #2 9. NARRATIVE DESCRIPTION: The applicant's property is located at 1524 Front Street, in the Town of Beaufort, Carteret County. The property is bordered on the north by Front Street and to the south by Taylor Creek. A single-family residence has been constructed on the property and is now in the process of being remodelled. CAMA Permit 42-88 was issued to the previous land owner and authorized the construction of a large pier, finger piers and associated tie off pilings. This permit was later modified to include the placement of riprap along the shoreline waterward an existing bulkhead. All permitted development has been completed. The new land owner now proposes to add a 30' long x 6' wide floating pier just east and parallel to the existing main pier. In order to gain access to this structure, a 16' long x 4' wide access ramp is proposed to connect the main "fixed" dock with an approx. 18' long x 4 to 8' wide landing area which will also be floating. A boat lift, approx. 13' long x 13' wide, is proposed to be located within an existing boatslip on the west side of the main pier. Two catwalks, approx. 9' long x up to 5' wide would provide access to the boat lift. The waters at the project site are classified as SC by the Environmental Management Commission and are closed to the harvesting of shellfishing. Water depths are approx. -10' mean low water deep at the location of the additions. 10. ANTICIPATED IMPACTS: The applicant proposes to construct several additions to an existing pier structure in Taylor Creek. These modifications would result in approx. 631 sq. ft. of additional public trust areas being "shaded" by these structures. The total "shaded" area of all the existing and proposed structures is approx. 5,000 sq. ft.. The neighbor to the east has waived the 15' riparian setback requirement. The boat lift on the west side of the project would be at least 15' from the riparian property line.
