violation of these terms may subject the permittee to a fine,
imprisonment or civil action; and may cause the permit to be-
come null and void.

permit officer when the project is inspected for compliance.

SUBJECT: New Hanover County - Replacement of Bridge No. 15 over Barnard's Creek on
SR 1100) T.I.P. No. B-2595, State Project No. 8.2250601, DOA Action

The North Carolina Department of Transportation proposes to replace the referenced
structure on existing location, along with associated approach improvements. The new bridge is
to be approximately 33.0 meters (108.2 feet) long and 9.6 meters (31.5 feet) wide. Navigation
will be accommodated with a vertical clearance of 1.7 meters (5.6 feet) above ordinary high
water. The elevation of the entire bridge will be raised 0.3 meter (1.0 foot) in order to meet
current design standards requiring an increased superstructure depth. This is a 21% increase in
the navigational clearance.

The proposed construction will require permanent fill in 0.002 hectare (0.005 acre) of �`
jurisdictional wetlands. Impacts will be restricted to a disturbed wetland fringe adjacent to the
southwest roadway shoulder. This fill area is necessitated by the increased footprint involved in
raising the bridge elevation. No excavation in wetlands will be required. No stream relocation or
channel change will be involved. Due to the minimal area of permanent wetland fill, no mitigation
is proposed.
The roadway will be closed within the project area throughout construction, and traffic
will be detoured onto other roadways. No temporary detour road , access canals or other
temporary fill/excavation in wetlands will be involved.

In order to minimize the effects of construction on anadromous fish utilizing Barnard's
Creek for spawning, a construction moratorium on instream work will be observed from March
through May 31. NCDOT's Best Management Practices for the Protection of Surface Waters
will be implemented throughout construction.
The scope of work for this project was documented in a Categorical Exclusion approved
by the Federal Highway Administration on August 3, 1995. The U.S. Army Corps of Engineers
issued Nationwide Permit No. 23 (Approved Categorical Exclusions) for this project on
February 5, 1996. Copies of this document are available upon request. Please note that the
design recommended in this document involved replacement of the existing bridge with a double-
barreled box culvert. The project has since been re -designed to involve replacement of the
existing structure with a new bridge. This reduced the wetland and terrestrial impacts associated
with the project. All other project benefits and environmental effects discussed in the document
remain unchanged.
On September 4, 1996, Ms. Cyndi Bell of NCDOT met onsite with Ms. Tere Barrett of
DCM to discuss permit requirements for this project. At that time, it was concluded that this
project meets the conditions of DCM's General Permit for Replacement of Existing Bridges and
Culverts in Estuarine Waters, Estuarine Shorelines, Public Trust Areas, and Coastal Wetlands.
Application for this CAMA General Permit is hereby made. An application form and set of permit
drawings are enclosed. A check in the amount of $50.00 has been transmitted to the DCM office
in Raleigh to cover the CAMA processing fee. A copy of the check is included herein. The four
adjacent property owners received notification of this request on October 1, 1996. The signed
certified mail return receipts (green cards) from these property owners are attached. None of the
property owners have since contacted us with any questions or objections to this project. As their
ten-day comment period following notification has elapsed, we interpret this as no objection to
our proposed work. By copy of this information, a request for 401 Water Quality Certification by
the North Carolina Division of Water Quality is hereby made.
