The proposed project to be located and constructed as described
above is hereby certified as exempt from the CAMA permit re-
quirement pursuant -to 15 NCAC 7K :0203. This exemption to
CAMA permit requirements does not alleviate the necessity of
your obtaining any other State, Federal, or Local authorization.

This certification of exemption from requiring a CAMA permit is
valid for90-`d'ays from the date of issuance. Following expiration,
a re-examination of the project and project site may be necessary
to continue this certification.

Any person who proceeds with a development without the con-
sent of a CAMA official under the mistaken assumption that the
development is exempted, will be in violation of the CAMA if there
is a subsequent determination that a permit was required for the
development.
The applicant certifies by signing this exemption that (1) the ap-
plicant has read and will abide by the conditions of this exemp-
tion, and (2) a written statement has been obtained from adjacent
landowners certifying that they have no objections to the
proposed work.

Repair work to be done to jetty adjacent
to Cherry Branch HOA property
This is to inform you that we have no objections to the
repair work scheduled to be performed to the jetty on your
property, as shown on the attached exhibit to this letter.
You may use Cherry Branch roads and the common area to the
private beach provided you repair any road damage and/or common
area damage that may be caused by the use of equipment and trucks
hauling rock.
This repair work is anticipated to be completed by the end
of 1997 and permission is hereby granted for that time period.
As consideration for this license, you have agreed to move the
fence from the beach area to the bottom or top of the cliff.
Upon completion of work you have also agreed to clean the area of
debris, including any of the beach area that may have been
disturbed. The State is also to hold the HOA harmless, including
attorneys fees, from any claims by you or third parties as a
result of the use of our property.
This permission is subject to revocation without notice if,
in the opinion of the HOA, the truck drivers or equipment are
recklessly endangering life or property at Cherry Branch.
Please have Mr. Jerry Gaskill sign a copy of this letter and
return to me prior to beginning work.
