The proposed project to be located and constructed as described
above is hereby certified as exempt from the CAMA permit re-
quirement pursuant to 15 NCAC 7K .0203. This exemption to
CAMA permit requirements does not alleviate the necessity of
your obtaining any other State, Federal, or Local authorization.

This certification of exemption from requiring a CAMA permit is
valid for 90 days from the date of issuance. Following expiration,
a re-examination of the project and project site may be necessary
to continue this certification.

Any person who proceeds with a development without the con-
sent of a CAMA official under the mistaken assumption that the
development is exempted, will be in violation of the CAMA if there
is a subsequent determination that a permit was required for the
development.
The applicant certifies by signing this exemption that (1) the ap-
plicant has read and will abide by the conditions of this exemp-
tion, and (2) a written statement has been obtained from adjacent
landowners certifying that they have no objections to the
proposed work.

Enclosed are the drawings you requested on the Kerr Street Water Front Park pier.
I have also enclosed the documentation of why we needed to change the original
design of this pier.
We will need a permit to replace this pier, for it was severely damaged by
Hurricane Fran.

Dear Kathy:
It was necessary for us to request a change on our LAMA Permit for
the Kerr Street Waterfront Park Project. The contractor was unable
to construct the fishing pier and deck in the location first
submitted in our application because of unforeseen debris and depth
problems in that location.
As a result, we have requested a change in the location and design
of this item. Enclosed you will find a map detailing the changes
as requested. The cost and square footage of the idea will remain
the same.

Subject: Justification for relocation of the originally planned 77
foot projected pier at the Kerr Street Park.
When the contractor attempted to jet piers in place he found that the first
25-29 feet from the shore line out was a trash dump consisting of logs, both
treated and untreated, short and long dimensioned lumber, cement blocks, boat
seats, brick rubble, and an abundance of broken asphalt pavement. It was
impossible for him to find a place to get his pipe in. He also found a shelf exists
about 34 feet out running parallel with the shore line. At that point the water is
approximately 7 feet deep extending out 10 feet the depth increased to 11 feet.
Therefore, we are requesting relocation of the pier to the position shown on
addendum sketch "A". This sketch shows the configuration of the river bed shelf
and water depths. In essence, we are following the shelf configuration which will
have the outside edge in approximately 6 feet of water at low tide. At the original
pier location, the contractor would be working in water depths of up to 14-16 feet
of water at low tide. The 6 x 6 piling would be extended vertically in excess of 12
feet without any transverse bracing. By moving the pier to the location shown on
Addendum Sketch "A" we would have the pier in shallower water and far enough
out to be beyond the largest part of the trash pile.
