The proposed project to be located and constructed as described
above is hereby certified as exempt from the CAMA permit re-
quirement pursuant to 15 NCAC 7K .0203. This exemption to
CAMA permit requirements does not alleviate the necessity of
your obtaining any other State, Federal, or Local authorization.

valid for 90 days from the date of issuance. Following expiration,
a re-examination of the project and project site may be necessary
to continue this certification.

Any person who proceeds with a development without the con-
sent of a CAMA official under the mistaken assumption that the
development is exempted, will be in violation of the CAMA if there
is a subsequent determination that a permit was required for the
development.
The applicant certifies by signing this exemption that (1) the ap-
plicant has read and will abide by the conditions of this exemp-
tion, and (2) a written statement has been obtained from adjacent
landowners certifying that they have no objections to the
proposed work.

attached plats sheets 1-5 of 5 dated 1/90, and pages 12 and 19 of the Avenel restrictive covenants
This permit, issued on May 17, 1990 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. A_ny violation of these terms may be
subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
1) The pier and associated structures shall have a minimum setback of 15 feet
between any parts of the structure and the adjacent property lines as extended
perpendicular to the channel into the water at the points where they intersect
the shoreline, including adjacent deeded submerged lands claims.
2) No more than 28 boats may be docked at the marina facility. The access pier
and the landward side of the floating dock may not be used to increase facility
.capacity.
3) No boats shall be allowed which are more than twenty-one (21) feet in length;
and no boats with toilet facilities or heads of any type are allowed.
4) No part of the access pier, floating docks, or tie piles may exceed 1/3 the
width of the waterway .at the project site. ,

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the'case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31. '1993
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

Chairman of the Coastal Resources Commission.

ADDITIONAL CONDITIONS
5) In accordance with Section 17, page 12 of the Avenel restrictive covenants,
(attached) no private boat docks or piers will be constructed on individual
lots.
6) For navigation purposes, an arch will be incorporated in the fixed pier
leading to the floating dock for small boat access (as depicted by the cross
section on sheet 3 of 5 dated 1/90.)
7) No sewage, whether treated or untreated, shall be discharged at any time from
boats using the marina. Any sewage discharge at the marina shall be
considered a violation of this permit for which the permittee is responsible.
This prohibition shall be applied and enforced throughout the entire existence
of the permitted structure.
8) This permit authorizes only the docks, piers, and other structures and uses
located in or over the water that are expressly and specifically set forth in
the permit application. No other structures, whether floating or stationary,
may become a part of this marina without permit modification. No non -water
dependent uses of structures may be conducted on, in, or over public trust
waters without permit modification.
9) The activity will be conducted in such a manner as to prevent significant
increases in turbidity outside the area of construction or
construction -related discharge.
10) The permittee's scheme of development, of which the authorized work is a part,
contemplates the presence of structures and their attendant utilities on lands
subject,to an easement in favor.of the United States for the operation,
maintenance, improvement, and enlargement of the "Atlantic Intracbastal.
Waterway (AIM . . Accordingly, the permittee will be required to remove such' -
structures and -improvements at his own expense in the event that, in the
judgement of the U. S. Army"Corps of Engineers acting on behalf of the United_
States, the lands are needed at any time for any purpose within the scope of
the easement. Permanent buildings will not be constructed within the
easement.
11) Approval of the structure was based on determination that there would be no
obstruction to navigation. Under conditions existing in the Atlantic
Intracoastal Waterway (AIWW), a possibility exists that the structure may be
damaged by wave wash from passing vessels. Unreasonable slowing down of
vessel traffic cannot be required because it would tend to nullify the
navigational benefits on which the AIWW was justified. Issuance of this
permit should not be construed as relieving the permittee of taking proper
steps to insure the structure and moored boats will not be damaged by wave
wash normally to be expected in the AIWW.

ADDITIONAL CONDITIONS
12) No attempt will be made by the permittee to prevent the full and free use by
the public of all navigable waters at or adjacent to the authorized work. Use
of the permitted activity must not interfere with the public's right to free
navigation on all navigable waters of the United States.
13) The permittee will maintain the authorized work in good condition and in
conformance with the terms and conditions of this permit. The permittee is
not relieved of this requirement if he abandons the project without having the
permit transferred to a third party.
14) The installation or use of fuel dispensing equipment, including pumps, piping
or tanks is not authorized at or on the pier structure.
NOTE: The permittee should contact the New Hanover County Health Department
regarding their requirements for septic tank installations (as required
under 10 NCAC 10A .1900 et. seq.). For information concerning septic
tank and other on -site waste disposal methods, contact the On -Site Sewage
Branch at (919) 733-2895.
