Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythat this project is consistent with the North Carolina Coastal Management Program.

Dear Mr. Small:
On November 29, 2006, Mr. John Cece, Field Representative for the North Carolina Division of Coastal
Management (DCM), issued General Permit (GP) 46447A to Alan Buchfuhrer for maintenance dredging
an area of Ginguite Creek adjacent to his property located at 6041 Martins Point Road, Martins Point
Subdivision, Kitty Hawk, NC. Your company is the authorized agent and contractor for Mr. Buchfuhrer
and you paid $200 for the permit fee with check number 13790 and Monica Small of your staff signed the
permit.
Ginguite Creek is a natural water body and a Primary Nursery Area (PNA), and our office has no record
of any dredging ever being done in Ginguite Creek. As such, your project does not qualify for the
07H.1500 General Permit for excavation within or connecting to existing canals: channels: basins: or
ditches in Estuarine Waters: Public Trust Waters; and Estuarine Shoreline Areas of Environmental
Concern, which allows excavation for the purpose of maintaining previous water depths.
CAMA GP 46447A obtained by you on behalf of Mr. Buchfuhrer was improperly issued and is therefore
invalid. GP 46447A is hereby revoked.
It is requested that you furnish our office with your Social Security Number and/or Federal Tax
Identification Number so that a refund check for $200 can be issued to you.
If your client desires to have this project authorized, he must submit a CAMA Major Permit application
for review.
