Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythatthis project is consistent with the North Carolina Coastal Management Program.

Re: Application for floating dock located at 509 Avery Street in Morehead City and
submitted by Martin Bolster.
Dear Sirs,
I am in receipt of a request for acceptance by an adjacent neighbor for a proposed floating
dock at the end of the existing pier at 509 Avery Street in Morehead City.
I am the property manager and part owner of the adjacent property at 511 Avery Street
that is located less than 50 feet to the west of the property proposing the floating dock.
We also have a pier extending to the North of our house and just west of the existing pier
at 509 Avery Street.
We are aware that there is a contract on that property and it may or may not be contingent
on the approval of the dock. We are also aware that the prospective buyer, Martin
Bolster, and person submitting this application is the owner of a local marine towing
operation.
At our owners annual meeting last night, on March 6th, 2007, this proposal was discussed
among the owners, and with a quorum of 6 out of 7 shareholders of the property, voted
unanimously to respond in this manner.
Since we are non-resident owners of this property, it is used as a retreat and vacation
home, where an atmosphere of relaxation and serenity is important. This property has
been in the families of the various owners since 1957, and most of the current owners can
remember spending our first few summer vacations there as small children. The property
is held in very high sentimental esteem by each of the current owners. We have
maintained an amicable and fair co -existence with Ms. Winters, the current owner, for the
27+ years that she has occupied her home. As a group, we have no intention on
obstructing in any way her right to sell her property. However, we do pay very close
attention to the intended use by future owners of that property. It is our greatest desire to
maintain the integrity of the serene setting on the marsh that both properties enjoy.
Therefore, our biggest fear as a group is that the property may be used for any type of
commercial activity. Given the nature of Mr. Bolster's marine enterprise (Sea Tow), we
cannot bless the construction of this dock if it is going to be used for business purposes. I
spoke with Mr. Bolster, and he assured me that the intended use was for personal vessels
only. In his application letter, he clearly states that the intended use is for personal use
only. It is not our intent to deny the owners of that property to enjoy all of the water AR 9 2007
assets that exist right out the back door, as long as they are not commercial aces

Our second concern, and equally important is one of safety for our pier and house. The
expanse of the Calico Creek and adjoining Newport River to the North and East of both
properties is very wide, and severely exposed to North and West winds in a storm. Our
concern is that a floating dock cannot be adequately secured to withstand Hurricane force
winds from the North and Northeast, and if it was to become detached, could very easily
do substantial damage to our property.
At this time, until these specific issues can be discussed and resolved, we are unable to
put our blessing on this proposal.

floating dock fixed to the North Eastern end of the existing pier. I have attached
my site plan sketch showing the existing property under contract in red, the
riparian rights lines in blue, Normal high water line in green and the site of the
proposed floating dock in light green bordered with dark green. As you can see
my proposed project stay's well inside the riparian lines and inside the foot print
of the existing pier.
The addition of this floating dock will make it much easier for my family and I to
access the wonderful waters of the local area to enjoy boating, sailing and fishing
and a cool swim on a hot summer day.
I look forward to meeting all of our new neighbors and hope you have no
objection to our proposal.
