Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

I would like to repair the dock damaged by a hurricane on lot 55 two lots
over from yours. I would also like to clean out and pipe the drainage
easement about a seventy foot section "crossing" the back of 54(the lot next
to your home) and empties into the drainage ditch labeled "A" and the ditch
marked "A".
I would appreciate your reviewing the Adjacent Riparian Property Owner
Statement and consent.
I do not ask you to waive the set back requirement (part of the same form) as
I do not intend to even come close to you property line.

On 6/16/2006, I received an Adjacent Riparian Property Owner NotificatioiVWaaver
Form coiupleted by Robert N. Barefoot, 1007 Wharton Street, Greensboro, NC 27401. Mr.
Barefoot owes Lots 54 and 55, Ensign Road on Pierce Creek Canal, in Oriental, Painlico County,
NC. I own Lot 56, which is adjacent to these lots.
Mr. Barefoot proposes to repair or replace a dock damaged by a hurricane on Lot 55,
utilizing the original foot print and the same dimensions/location. He also plans to clean out and
restore a drainage ditch located on Lot 54. While I don't have any objection to Mr. Barefoot's
efforts to improve his property, I am not certain why I am being asked to waive the 15 foot
setback requirement. It appears Mr. Barefoot could accomplish these improvements without
affecting my 15 foot area of riparian access.
As I need more information in order to make an informed decision regarding this matter.. I
cannot waive the 15 foot setback requirement at this time.

Dear Property Owner;
Attached is the: Adjacent Riparian Property Owner Statement, Certified Mail
Return Receipt Request along with a copy of the survey of the properties.
I plan to repair and or replace the dock damaged by the last hurricane shown in the
survey on lot 55 utilizing the same foot print and the same dimensions/location.
Y also plan to clean out and restore the drainage ditch to its original size and depth
as it holds stagnant eater in low water conditions (wind out of the south west).. I
also play to pipe the water crossing the property over the esting drainage
easement into this drainage ditch to avoid further erosion and silting of the canal.
The drainage ditch area is shown on lot 54 of this survey.
I hope this answers any questions you may have. Please don't hesitate to call me if
you have any questions or would like to meet with me in pQrson to discuss this or
anything else.
