Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available information and belief, certify that this project is consistent with the North Carolina Coastal Management Program. West, Jr's property located at 146 Wallace Road, Shell Landing, on Poll Bridge Branch, in Beaufort, NC 28516. He has described to me as shown below, the development he is proposing at that location, and, I have no objection to his proposal. DESCRIPTION AND/OR DRAWING OF PROPOSED DEVELOPMENT 1. Replace existing bulkhead on North side of Basin ramp (approx 40-feet) within two feet of existing structure. 2. Replace existing concrete ramp (which is an extension of existing driveway) and widen approx two feet, cost of which will be divided equally by the property owners of 146 and 152 Wallace Road, after review of ramp replacement estimate(s) and work completion. This will fulfill and maintain the Riparian Agreement, dated 4 June 1994 (specifically Section 4). 3. Replace existing driveway (approx 9-feet in width) with a new concrete driveway (approx 12- feet in width and 4-inches in depth). Driveway will be straightened to conform to property line on South side, and connect to existing pad in front of 152 Wallace Road residence. Driveway's apron will connect to Wallace Road. Driveway will be graded to eliminate existing low spots, thus facilitating drainage from 146 Wallace Road property. Driveway will be appropriately graded to facilitate drainage between the two properties and will not impede ingress or egress to boat ramp. 4. The new driveway will remain connected to the existing driveway of 146 Wallace Road from the top of the boat ramp approximately 35 feet west, along the North property line. The new driveway will be connected in a manner as to not impede ingress or egress from 146 Wallace Road onto the proposed new driveway for 152 Wallace Road.
