GUARDIAN®-FET. BIDED. W Division of Coastal Management 400 Commerce Ave. Morehead City, NC 285557 Dear Sirs, P.O. Box 272 Merritt, NC 28556 Dec. 16, 2005 1 9 Z005 Morehead City DGM I am in receipt of documents from Eastern Environmental Assoc, of Beaufort, NC regarding a proposed plan to "replacelrepair an existing walkway, and construct a 400 sq. ft. floating dock on Moores Creek" in Florence, Pamlico County, NC (copies enclosed). The referenced property is immediately adjacent to, and also directly opposite of properties I own on Moores Creek, and I have some concerns which I hope your agency will address and respond to me during the permitting process. While I have no objection to anyone legally developing or improving their property, my first concern is that in light of recent actions taken by the owner of this site, which are a matter of record with your agency, I would hope that you will be able to ensure complete compliance with all applicable law and regulations, perhaps by way of a performance bond if you are so empowered. My second concern is with the efficacy of a floating dock. In light of extensive damage to many conventional (piling) docks during storms in recent years - a weather trend which is predicted to continue, a floating dock seems very ill advised. The best example I can provide is the approximately 40' section of floating dock currently on site. During one storm this season, it was picked up, turned about 45 degrees, and deposited on top of the existing older dock (which I assume lead to this proposed project). I would prefer to see a conventional fixed dock providing some assurance that I won't be wearing my neighbor's dock atop mine if the wind/water direction is a little different next time. In closing, 1 thank you for allowing my input into this proposal, and look forward to your response to my concerns. era' Harry Nvin, (251) 745-7821 LL DI I.STON OF C O.-1STAT. t)WNER, NOTUICATIONA VAIVER FORM ;;triar (f iutliiclul Ippiviiip, for :lrlcizc.s5 of lraiacrly:--_`.2..C----.1^'/ ..t.._ S ,.
