Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action, and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

Dear Ms. Barrett:
On behalf of the Town of Swansboro, North Carolina, please accept this letter as
application for a CAMA general permit for the above referenced project. This project will
include approximately 34,454 LF 12" Dia. reclaimed water main extension, a proposed
reclaimed water disposal sprayfield site, as well as improvements to the existing Town of
Swansboro WWTP. Please note a portion of this project was already permitted under General
Permit No. 36716-C. This portion included the 12" Dia. reclaimed water main from the WWTP
to just north of Halls Creek along Hammocks Beach Road (SR 1511), see attached.
Please find each of the following items enclosed for your review:
• One (1) copy of Proposed Wastewater Treatment And Disposal System map
showing the location of all wastewater improvements to be performed.
One (1) copy of notification letter sent to adjacent property owners of this
project. (Green Card will be submitted upon receipt)
In addition, please find attached check in the amount of $100.00 to cover the application
fee.

Dear Mr. Shaver:
This letter provides the comments of the U. S. Fish and Wildlife Service (Service) on the information
provided to this office by letter dated February 23, 2005, from Green Engineering on the subject PN,
dated December 20, 2004. The information addresses the preliminary site selection process for the
reclaimed water irrigation sprayfield proposed by the Town of Swansboro. The information is in
response to Service comments to you, dated January 25, 2005, on the proposed work. These comments as
well as our earlier letter are submitted in accordance with the Fish and Wildlife Coordination Act
(FWCA) (48 Stat. 401, as amended; 16 U.S.C. 661-667d). Comments related to the FWCA are to be used
in your determination of compliance with 404(b)(1) guidelines (40 CFR 230) and in your public interest
review (33 CFR 320.4) in relation to the protection of fish and wildlife resources.
The Town of Swansboro applied for a Department of the Army (DA) permit to impact 1.01 acres of
jurisdictional wetlands and 1.65 acres of isolated, non jurisdictional wetlands to construct water
sprayfield for treated effluent. The proposed site is located off Parkertown Road and contains a portion of
Pasture Branch which is tributary to Queen Creek. The proposed work would impact headwater wetlands
of Pasture Branch. The wetland impacts are associated with the construction of a 10 -acre water holding
pond. Sprinklers and the pumping station would be constructed in non -wetlands.
The Service expressed concern that a reclaimed water holding pond is not a water -dependent structure.
Such a diked, holding pond could be constructed in uplands. Your letter of December 17, 2004, informed
the applicant that permits for work within wetlands or other aquatic sites are available only if the
proposed work is the least environmentally damaging, practicable alternative. You requested information
regarding any other alternatives, including upland alternatives, for the proposed disposal site and
sprayfield. The Service supported your efforts to ensure the consideration of upland sites for this work.
In regard to the avoidance and minimization of wetland impacts, the Service considered two aspects of
the project. These aspects are: (1) the selection of the site; and, (2) the placement of facilities within the
selected site. The letter from Green Engineering addresses the first aspect. Our review of this
information indicates that the Parkertown Road Site, the third of three sites considered and the one
preferred by the applicant, appears to be the least environmental damaging location. We support the
efforts to locate the snrayfield as far as possible from surface waters which flow into Queen Creek.

Regarding the placement of facilities within the 218 -acre site, the Service is pleased that encroachment on
the surface waterways appears to have been minimized. Similarly, the placement of the sprayfields
appears to have avoided wetlands. The impacts to wetlands, both jurisdictional and isolated, are
associated with the 10 -acre water holding pond. A reduction in the size of the storage pond and/or
changes in the shape of the dike could reduce wetland impacts. However, the Service does not have the
engineering expertise or knowledge of any design constraints necessary to made specific
recommendations on the size, shape, or location of the holding pond.
The Service continues to recommend that compensatory wetland mitigation should consist of in-kind
restoration in the immediate vicinity of the unavoidable wetland losses. Compensation by payment to the
North Carolina Ecosystem Enhancement Program (NCEEP) does not allow an evaluation of the type or
location of the mitigation wetlands. The Service continues to encourage the applicant to look for
restoration or enhancement opportunities along Queen Creek or some of the tributaries to this creek.
After adequate restoration or enhancement, preservation could be considered as part of the overall
mitigation effort.
Based on the information provided by Green Engineering, we find that the applicant has demonstrated
that alternative sites were evaluated and that the Parkertown Road Site, selected by the applicant, is the
least damaging site. Regarding the placement of facilities within this site, project plans indicate
avoidance and minimization in the siting of the sprayfield zones and pumping station. Based on this
information and a presumed desire to reduce the cost of compensatory mitigation, we have no reason to
conclude that the size or design of the water holding pond could be changed to reduce wetland impacts.
Therefore, we would concur that the wetland impacts specified in the PN are unavoidable.

received from your office on April 4, 2004:
Comment No. 1: According to Mr. Ken Pohlig of DWQ's Construction Grants and
Loans Section, the Town will be required to grade and install a
liner in the footprint of the storage lagoon. Therefore this activity
will result in a discharge of fill material to the isolated wetlands
PAYMENT within the footprint of the lagoon and an isolated wetland permit
will be required for this fill. Since the total impact for the lagoon
RECEIVED exceeds one acre, compensatory mitigation at a 2:1 ratio will be
required in this permit. Please provide a mitigation plan that meets
the requirements of 15A NCAC 21-1.1305(g). In addition, DWQ
will need to prepare a Public Notice for this project once the
mitigation and monitoring plans (see below) are prepared.
Response No. 1: The appropriate wetlands permits have been filed with NCDENR-
DWQ and the USA COE. The Town of Swansboro intends to buy
into the Ecosystem Enhancement Program (EEP) in lieu of
providing a mitigation plan. A request allowing the Town of
Swansboro to buy into the EEP has been made by the Town.

Comment No. 2: As discussed with Mr. Green, discharge of treated wastewater into
a portion of the remaining isolated wetlands on the site is exempt
from the isolated wetland rules. However as discussed, we may
recommend that monitoring be included in DWQ's non -discharge
permit for these areas in order to be sure that wetland impacts are
minimal. I believe that a site visit will be needed to determine the
need for monitoring and am in the process of scheduling a site visit
with Kim Colson (Non -Discharge Unit), Ken Pohlig (Construction
Grants and Loans Section), Ed Schwartzman of the Wetlands Unit
and Noelle Lutheran (DWQ's Wilmington Regional Office) as
well as yourself. Once we have a tentative date for the meeting, I
will call you to confirm.
Response No. 2: A visit to the site has been made to view the subject isolated
wetlands and there will be some minor irrigation discharges into
isolated wetlands as the rule allows.
Comment No. 3: According to Mr. Colson, the location of spray fields near wetlands
may require additional setbacks or a variance from the setback
rules. Please call Mr. Colson at 919-733-5083, ext. 540 to clarify
and discuss this issue.
Response No. 3: In accordance with NC Administrative Code Section ISA NCAC
02H 0.0219 (k)(1)(c)0)(IV) the following have been maintained. -

Also, in accordance with NC Administrative Code Section 15A

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower -impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
No intermediate or verennial streams will be impacted by the construction of this vroiect. The
pond is designed with a combination of minimal disturbance to wetlands, economical layQut and
operation efficiency in mind The pond surface area is dependent on storage required and
elevation of invert as required by the groundwater table for design. Wetland impacts have been
limited to two (2) distinct areas, one on the north dike and one on the south side dike of the pond

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE — In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetiands/strm,gide.htm].

as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreagellinear feet)

PROJECT NARRATIVE
WASTEWATER TREATMENT PLANT IMPROVEMENTS
TOWN OF SWANSBORO, NORTH CAROLINA

Proiect Description
The Town of Swansboro is planning improvements to the existing wastewater treatment
plant just off of Old Hammocks Road (SR 1512). The purpose of this project is to
provide an alternative disposal site for treated effluent from the existing discharge into
Foster's Creek as well as upgrading plant capacity. The scope of this project is the
creation of a new reclaimed water disposal site in conjunction with improvements at the
WWTP to provide reclaimed water transport and disposal. The proposed reclaimed water
sprayfield, located just north of the intersection of SR 1744 and NC Hwy. 24, will utilize
approximately 68,141 LF 2-12" Dia. irrigation piping, one (1) 10.0 acre irrigation storage
pond, one (1) irrigation pumping station and all associated sprinklers, valves, fittings, etc.
to serve the proposed sprayfield. Improvements to the WWTP will include the addition
of a new aeration basin, clarifier, UV Disinfection, sludge holding tank, sludge pumping
station, effluent pumping station, 3.0 acre 5 -day holding lagoon, and all associated
piping, valves, fittings, etc. The reclaimed water transmission main from the WWTP to
the proposed spray disposal site was previously permitted under "Swansboro Wastewater
Improvements — Project No. ON -03249" issued on May 19, 2003. The total project area
is approximately 30 acres. A minimum of 3' depth cover will be maintained throughout
all reclaimed water irrigation piping installation.
Site Description
The topography in the project area consists of mild slopes and coastal wetlands with
slopes ranging from flat to 10 %. An 8.0 ft. wide construction corridor was used in
estimation of area to be disturbed by installation of reclaimed water irrigation piping
within the sprayfield. Typical soil types throughout the project area are BaB (Baymeade
fine sand), To (Torhunta fine sandy loam), and GoA (Goldsboro fine sandy loam).
Construction Sequence
Due to the nature of spray irrigation facility construction, construction of specific
irrigation zones will be staged. Typically, a crew will install irrigation mains first and
then follow with the installation of laterals, risers and sprinkler heads to complete the
field. Given the high number of irrigation piping required it is doubtful a contractor will
install all zones simultaneously. Most likely, the contractor will install the sprayfield in
stages beginning in one zone, continuing to the next, and completing construction in the
last zone. This process should result in minimal land disturbance at a given point in time,
thus contributing minimal threat to local waterways.

Planned Erosion and Sedimentation Control Measures
1. Silt Fencing — Silt Fence will be installed as shown on the construction plans
or as deemed necessary by visual inspection. This will be done by the
contractor and inspected by the engineer to ensure all sediment is properly
contained.
2. Rock Check Dams — Rock Check Dams will be installed as a temporary
measure throughout the project to restrict the velocity within the disturbed
roadside ditches or channels affected thereby reducing the potential of
erosion. These check dams will also serve as temporary sediment traps and
will be placed wherever necessary as shown on the construction plans.
3. Temporary Inlet Protection — Inlet protection will be provided on all existing
drainage pipes and inlets on the project to ensure proper sediment
containment.
4. Excelsior (curled wood) Temporary Matting — Roadside Ditch stabilization
will be provided by the use of curled wood matting in required areas either
as shown on construction plans or as deemed necessary by visual observation
of the construction site.
