Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

NQYE; Th(: permitter is advised that should any reconstruction or major maintenance be required to the
railroad trestle, it may be necessary to suspend use of the slips on the north side of Dock A to
allow access for construction equipment due to the close proximity of tho marina to the trestle.
In addition, the marina owners and/or vessel owners may bear full responsibility and costs for
any interruption in the use of the marina during this time.
36) The permittee understands and asmes that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in tht

of whether or not such commitments are addressed by individual conditions of this permit.
40) Any d`veloptncnt or bind disturbing activity that is considered non -water dependent is not authorized
within 30 foci of the normal high water level unless specifically exempted by Coastal Resource
Cotnrt7iSsion (CRC) reuulaiions in pi.tcc at the tine of such development.
