This permit is subject to compliance with this application, site
drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine, —
imprisonment or civil action; and may cause the permit to be-
come null and void.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
adjacent riparian landowners certifying that they have no
objections to the proposed work.
In issuing this permit the State of North Carolina certifies that
this project is consistent with the North Carolina Coastal
Management Program.

Mutual Waiver of Setback
The undersigned landowners agree and covenant as follows:
1. Mary Cox Gage is the owner in fee of a lot described as Dock Area No. 9,
Crojack Lane, Shandy Point, Wilmington, North Carolina, and further described
at Book 971, page 624, New Hanover County Registry.
2. Tania I. Bullard and Henry A. Young are owners in fee of a lot described
as Dock Area No. 10, Crojack Lane, Shandy Point, Wilmington, North Carolina,
and further described at Book 1565, page 215, New Hanover County Registry.
3. Each party represents that he or she has the authority and legal capacity to
enter into this agreement.
4. Each party agrees to a waiver of setback requirements made applicable to
the granting of a "General Permit for the Construction of Piers, Docks and Boat
Houses in Estuarine and Public Trust Waters" by NCAC 15A Sec. 07H.1200.
However, the waiver shall be effective only to the extent specified herein.
5. The consideration for this agreement is the mutual waiver effected herein.
6. Mary Cox Gage waives the setback requirement as it applies to the
proposed construction plan set forth on the attached "Sketch Plan #2." This
waiver is effective only as to that plan.

7. Tania I. Bullard and Henry A. Young agree that their pier will be built
according to the attached "Sketch Plan #2" and specifically agree:
a. That the fixed "deck" portion of their pier will be set back at least
four feet (4.0') from the parties' shared property line; and
b. That the "floating dock" portion of their pier will be set back at least
eight feet (8.0') from the parties' shared property line; and
C. That any "boat lift" constructed or installed will be on the side of the
floating dock opposite from the Gage property, as shown on "Sketch Plan
#2". and
d. Except as specified they will cause or allow no construction
including pilings, floats, boat lifts or anchorages, within eight feet (8.0') of
the parties' mutual property line.
8. Tania Bullard and Henry A. Young agree that Mary Cox Gage may replace
her existing pier or dock or build a new pier or dock with a deck if she should
decide to do so. Tania I. Bullard and Henry A. Young waive the setback
requirements that apply or may apply to such construction, provided that
a. Any fixed "deck" portion of the Gage pier will be set back at least
four feet (4.0') from the parties' shared property line; and
b. Any part of such dock or pier constructed for the mooring of boats
will be set back eight feet (8.0') to the parties' shared property line.
9. This agreement shall be binding on the parties, their heirs, successors and
assigns.
10. The date of this agreement is 1992.
