Dear Colonel Allen:
This acknowledges receipt of your letter dated May 28, 1991
in which you outlined your objections to construction of the
roof -covered boat lift as proposed by your neighbor, Dr. William
C. Smith. In addition, I appreciate the time and effort you made
in visiting my office on Monday, June 3, 1991.
As I explained, I have reviewed the merits of Dr. Smith's
proposal with my Supervisor, Mr. Charles S. Jones, and, we have
determined that the project is consistent with 15 NCAC,
Subchapter 7H.0208(b)(6), and the provisions of the General
Permit 7H.1200. I have attached for your consideration a copy of
Dr. Smith's Permit #GP-C8021 and the workplat drawing. Also
attached is a copy of the Third -Party Appeal form that you may
use to initiate the administrative process within the next twenty
(20) days.
Thank you for the concerns you have expressed with our
coastal program, and if I may assist you further, please do not

I do not approve of Mr. W.C. Smith's proposed boat house for the
following reasons:
1. I do not believe boat houses on small, limited
waterways such as Wilson Creek add to the beauty,
view, and enjoyment of property owners in general.
They are eventually ignored, allowed to deteriorate
and become unsightly to the detriment of the area.
2. As concerns the site of Mr. Smith's proposed boat
house I am convinced it will limit my view of the
creek and adversely affect the beauty and the
relative value of our property.
3. I have repeatedly advised that I have no objections
to a free standing boat lift that is not enclosed or
covered. If he desires to keep his boat "out of the
water" this should serve his purpose.
4. I submit that if you or Mr. Smith were in my
position you would not welcome a covered boat house
as proposed.
5'. The following is background of my position:
A) In 1983 he "advised" that he was going to build
a boat house - I objected. He proceeded to
have Tom McNight drive the piles anyway. That
resulted in my contacting Donald Bumgardner and
filing a written objection (Enc.1)
B) In 1989 Dan Foley advised that he was to build
Mr. Smith's boat house. Consequently, I
re -filed my objection with Mr. Bumgardner's
office (Enc.l). His office advised me to
contact your office concerning the permit which
I did. To my dismay your office had a permit
request on file with my name on it.

On learning that I had neither seen or signed the permit you -,/
office advised that they would cancel the request. Jim, if you have
retained your files for July 1989, you can confirm this.
Finally I want very much to get along with my neighbors and have
tried to do so, but I can not agree to actions that I am convinced
will abuse me.
