Schecter William W Cobey, Jr., Secretary Director oa STA7F a b 5 December 1990 Mr. James Swanner Jr. Route 1, Box 679 Plymouth, North Carolina 27962 Dear Mr. Swanner: This letter is in reference to our telephone conversation on 4 December 1990 and my subsequent site visits to your property on North Creek on 5 and 6 December 1990. The purpose of the telephone conversation was to discuss changes on General Permit #6624-B. General Permit #6624-B was issued to you on 16 October 1990 for the construction of a bulkhead on your property off SR 1731 on North Creek in Beaufort County. North Carolina Administrative Code (herein abbreviated N.C.A.C.) T15A:07H.1105(a) states: "This general permit is applicable only along shorelines void of wetland vegetation including marsh grass and wooded swamp, or where all construction is to be accomplished landward of such vegetation." As we discussed, my original bulkhead alignment was waterward of coastal wetlands. These wetlands contain both marsh grass species under the jurisdiction of the Division of Coastal Management and other wetland species under the jurisdiction of the U.S. Army Corps of Engineers. Because the original alignment violated N.C.A.C. T15A:07H.1105(a), the alignment must be moved landward and out of coastal wetlands. Raleigh Bland (Field Representative for the Division of Coastal Management in the Washington Regional Office) and I were onsite the aforementioned property on 5 December 1990 to change the alignment of the bulkhead. This alignment delineates the change from upland grass species to wetland species and has been verified by Terry Moore (District Manager for the Division of Coastal Management in the Washington Regional Office). David Lekson (U.S. Army Corps of Engineers, COE District Manager), Raleigh Bland and I were onsite the aforementioned property on 6 December 1990. The purpose of Mr. Lekson's visit was to delineate COE jurisdictional wetlands as per your request. Mr. Lekson delineated a line consistent with current federal regulations. If you have any questions concerning COE criteria for wetlands you can contact Mr. David Lekson at 919-975-3123 in the Washington Office. The line delineated by Mr. Lekson is landward of the line delineated by the Division of Coastal Management and will be the alignment for the proposed bulkhead. The new alignment conforms to P.O. I have enclosed a copy of GP #6624-B that has been modified to show the change in the alignment. As we discussed, rock riprap can be used in place of a wooden bulkhead as long as the toe of the riprap is landward of the new staked alignment.
