This permit is subject to compliance with this application, site
drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine,
imprisonment or civil action; and may cause the permit to be-
come null and void.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
adjacent riparian landowners certifying that they have no
objections to the proposed work.

The North Carolina Department of Transportation (N(7DOT)
intends to propose leaving the ferry access road. and. loadi.ug
ramps for use in future emergencies. This matter has been
discussed with the Cape Hatteras National Seashore and the
U.S. Fish and Wildlife Service (USFWS). Our submission Of
the modification request has been delayed while we develop a
mitigation plan for the permanent wetland impacts caused by
leaving the structures in place.
At this time, NCDOT foresees rehabilitating waterfowl.
ponds on the Pea Island National Wildlife Refuge to meet our
mitigation requirements. We will be meeting with Refuge
personnel the last week of June to discuss our intentions and
examine the mitigation site. once our plans are finalized.,
we will submit a formal modification request for. Permit
7642A.

areas suitable for coastal marsh restoration or creation.
This difficulty, and the need to coordinate with other
agencies, has precipitated the delay in our modification
request. NCDOT has given a high priority to completing the

Dear Dr. Goode:
This letter will refine CAMA emergency permit #7642A issued
to you on January 25, 1991 for the emergency ferry ramps, dolphin
clusters and an access road at Oregon Inlet, Dare County.
This letter will allow the removal of sand and silt blown
into the boat ramp basin and into the marina basin by NC DOT
ferrys using the northern ferry ramp at Oregon Inlet. This
maintenance excavation is limited to the 2 areas identified on a
plat transmitted by telecopier to the Elizabeth City Field Office
on March 9, 1991. That area identified as Area 1 shall be
limited to -8' MLW and Area 2 shall be limited in depth to -7'
MLW. The excavation shall be carried out by a hydraulic dredge
with all spoil material pumped to the existing spoil disposal
site at the U.S. Coast Guard Station at Oregon Inlet.
This refinement is subject to the following conditions:
1) This authorization is for a one time excavation only;
no future excavation may be conducted under this
authorization.
2) All excavation must be completed by April 1, 1991 so
as to minimize impacts to fishery resources.
3) No marsh grass will be excavated and/or filled.

(4) The temporary placement or double handling of
excavated or fill materials within waters or
vegetated wetlands is not authorized.
(5) No excavated or fill material will be placed at any
time in any marsh or surrounding waters outside of
the existing, spoil disposal area.
(6) All excavated materials will be confined above mean
high water -and landward of regularly or irregularly
flooded marsh behind adequate dikes or other
retaining structures to prevent spill -over of solids
into any marsh or surrounding waters.
(7) The disposal area effluent will be contained by pipe,
trough or similar device to a point at or beyond the
normal ---- water level to prevent gully erosion and
unnecessary siltation.
(8) The terminal end of the pipeline will be positioned
at or greater than fifty (50) feet from any part of
the dike and a maximum distance from spillways to
allow settlement of suspended solids.
(9) A water control structure will be installed at the
intake end of the effluent pipe to assure compliance
with water quality standards.
(10) The diked disposal area will be constructed a
sufficient distance from the mean high water level or
any marsh to eliminate the possibility of dike
erosion into or upon any marsh and/or surrounding
waters.
(11) The dike and spoil area will be properly graded and
provided a ground cover sufficient to restrain
erosion within thirty (30) working days of project
completion.
This refinement letter should be attached to CAMA emergency
permit #7642A and be available onsite for review by state and
federal agencies.

PERMIT CONDITIONS
(1) The fill road and ferry ramps on Pea Island shall not extend
beyond the limits of the special use area designated in the
Special Use Permit of the U.S. Fish and Wildlife Service.
(2) All fill placed in wetlands for construction of an access
road to the ferry ramp on Pea Island shall be removed within
90 days of the reestablishment of vehicular traffic on the
Herbert Bonner Bridge and the discontinuation of emergency
ferry service. Pre-existing elevations and contours shall
be reestablished.
(3) Appropriate wetland vegetation shall be sprigged in the fill
areas within 120 days of the reestablishment of vehicular
traffic on the Herbert Bonner Bridge and the discontinuation
of emergency ferry service. Wetland elevations and
appropriate vegetation shall be decided upon in
consultation with the NC Division of Coastal Management.
(4) All ferry ramp structures and dolphin clusters shall be
removed within 90 days of the reestablishment of vehicular
traffic on the Herbert Bonner Bridge and the discontinuation
of emergency ferry service. (Bodie Island and Pea Island).
(5) All pre-existing conditions at the public boat ramps and at
the parking areas at the Oregon Inlet Fishing Center shall
be reestablished within 120 days of the reestablishment of
vehicular traffic on the Herbert Bonner Bridge and the
discontinuation of emergency ferry service.

Dear Dr. Goode:
Please find attached an emergency CAMA permit authorizing
the construction of ferry ramps, dolphin clusters and an access
road for the emergency ferry service at Oregon Inlet, Dare
County. You will need to sign the permit at the bottom of the
page; keep the top copy for your records and return the other
copies to us.
This permit provides documentation for the verbal
authorization given onsite on 10/26/90 and 10/27/90 for the
construction of temporary ferry ramps and a temporary fill,
access road. The attached permit requires the complete removal
and restoration of the sites of the ferry ramps on Bodie and Pea
Islands. Should you desire to leave all or portions of the ferry
ramps and/or access road, you will need to request a
modification of this permit. Complete details will need to be
submitted with this request, includinq but not limited to
detailed plans, mitigation plans, etc. A modification request
should be initiated as soon as possible as this request will be
circulated to other state agencies for review and comment.

SUBJECT: Emergency work on Herbert C. Bonner Bridge, Oregon
Inlet, Dare County NC.
Reference is made to our letter of November 6, 1990
requesting issuance of a CAMA permit for emergency repair
work on Bonner Bridge. This permit allowed the construction
of a temporary offloading area and approach road on the west
side of the bridge. Upon completion of bridge repairs, these
access areas will be restored to pre -project grade. This
area will be replanted with appropriate coastal wetland
vegetation (i.e. spartina lterniflora ).

U.S. Army Corps of Engineers regarding that agency's

authorized the construction of ferry ramps, dolphin clusters
and an access road for the emergency ferry service at Oregon
Inlet, Dare County. However, this permit requires the
complete removal and restoration of the ferry ramp sites on
Bodie and Pea Islands.
The North Carolina Department of Transportation intends
to propose leaving the ferry access road and loading ramps
for use in future emergencies. This matter has been
discussed with the Cape Hatteras National Seashore and the
U.S. Fish and Wildlife Service (USFWS). These agencies
appear to be receptive to granting the appropriate land use
permits, provided that NCDOT complies with certain
stipulations. Among these stipulations, USFWS is requiring
2:1 mitigation for the loss of 0.3 acres of salt marsh.
As you are aware, it is difficult to locate a site
suitable for marsh creation or restoration. We are currently
investigating a variety of options. Once we develop a
conceptual mitigation plan, we will submit our request for a
permit modification.
