The proposed project to be located and constructed as described
above is hereby certified as exempt from the CAMA permit re-
quirement pursuant to 15 NCAC 7K .0203. This exemption to
CAMA permit requirements does not alleviate the necessity of
your obtaining any other State, Federal, or Local authorization.

This certification of exemption from requiring a CAMA permit is
valid for 60 days from the date of issuance. Following expiration,
a re-examination of the project and project site may be necessary
to continue this certification.
Any person who proceeds with a development without the con-
sent of a CAMA official under the mistaken assumption that the Applicant's signature
development is exempted, will be in violation of the CAMA if there
is a subsequent determination that a permit was required for the
CAMA Official's signature
development.
The applicant certifies by signing this exemption that (1) the ap-
plicant has read and will abide by the conditions of this exemp-
tion, and (2) a written statement has been obtained from adjacent
landowners certifying that they have no objections to the
proposed work.

THIS DEED OF EASEMENT, made and entered into this 14th day of
June, 1991, by and between SADIE HYMAN, widow of CH,ARLES HYMAN,
party of the first part; and the CITY OF NEW BERN, a North Carolina
municipal corporation, party of the second part;

THAT, for and in consideration of the sum of One Dollar
($1.00) cash in hand paid to the party of the first part by the
party of the second part, receipt of which is hereby acknowledged,
and in further consideration of the benefits accruing, and which
may accrue, by the installation of a bulkhead along a portion of
the lot of the party of the first part which abuts Jack Smith's
Creek Canal, the party of the first part does hereby give, grant
and convey unto the party of the second part a perpetual right and
easement to construct and maintain across the land of the party of
the first part hereinbelow described a bulkhead along the edge of
Jack Smith's Creek Canal, which said bulkhead is depicted on a plat
entitled "CITY OF NEW BERN, ENGINEERING DEPT., 10' TEMPORARY AND
15' PERMANENT EASEMENTS FOR CONSTRUCTION AND MAINT. OF BULKHEAD AT
1304 WILLIAMs ST.," copy of which is attached hereto and
incorporated herein by reference, together with a perpetual right
of ingxess, egress and regress on the easement area located on the
property of the party of the first part which is hereinbelow

described, for the purpb$e of maintaining said bulkhead; PROVIDED,
HOWEVER, that in constructing, maintaining and repairing said
bulkhead, said party of the second part shall remove all surplus
earth, if any, make level the surface of the ground behind the
bulkhead, if appropriate, and interfere as little as is reasonably
possible with any planting or other improvements upon the property
of the party of the first part and shall restore the work area as
nearly to its preconstruction condition as is reasonably
practicable as soon as possible. The property over which said
easement is granted is more particularly described as follows!
A strip Of land fifteen (15 ) feet wide across Lot 317,
Mechanicsville, one of the lots conveyed to Charles Hyman
and wife, Sadie Hyman, by deed bearing date June 24,
1976, which appears of record in Book 872, at Page 286,
Craven County Registry. The easement area is more
particularly described as follows.
BEGINNING at a point in the northwesterly right-of-way
line of Williams Street, which said point is also 1n the
North
centerline of Jack Smith's Creek Canal; thence,
52° 00, East, along and with the said right -of• -way line,
15 feet; thence, North 42° 08' West, 100.2 feet, more

less, to the northwestern line of the property
party of the first part; thence, south 520 00' West
along and with said line 15 feet; thence, South 42 08
East, 100.2 feet, more or less, to the northwesterly
right-of-way lane of Williams Street, the point at
beginning.
Together with a temporary construction easement to be
used during the installation of the bulkhead and to
terminate on completion of installation, but, in any
event, on or before six (6) months from the date herehereof.

party of the second part, its successors and assigns.
