Boa 161 Havelock, NC 28532 Dear Al and Dick I received the results of the land surrey on Lot I3 this week and have been working to determine the mlatimships of my proposed dock to the existing docks- I have super imposed the riparian lines as developed by CAMA on my latest survey map- The CAMA lines are based on the plan that Sciot2 Jones and Ted T)rndall presented to us during m} March 8, 1999 visit to The Moorings_ As promised, I am sending both of you the results. The oatcome is sorn„o-w at surprising. According to the new information. I calculate that l.,ot 14 dock is M violation of the set back =Tiirement from the zipanan line by apprommat,;.ty 24 feet. This putts the construciim approximately 9 feet over the riparian lute and puts the dock design we came up Nvith in question_ I am afraid that my dock will be in gross violations of Dick's riparian line. One of the stapularion5 that I brad made during my last vises nas that the plan not violate any riparian lines or set back,. Mary -lane and I are not comfortable with building the dock so that it violates the riparian line or set back to atzy uureasonable extent. A verbal agrm rent made in goad faith today by both my neighbors rimy not Bold up when the aaginai people _have moves on. We do not want to leave ourselves open to this kind of situation. We bate made a very large investment in this property and naturally we want to protect it_ Al, during my latest visit to The Moorings, you mentioned that you believed thaw: your dock was built inside your riparian line set back by one foot- Illat means that you should hays expected your neighbor to build his dock, A& on his 15 feet riparian line set back as well. In this case, the minirunrn distance _von could expect between the dock construction would be about 31 fed. In view of the latest information" I am proposing to build my dock 31 ]feet away from vom dock. Basically, this new plan follows closely to the original permitted plan at the time of our purchase of the property. Regardless of anY proposed dcsigr4 it should not be consmied as a giving up of rnu riparian rights. The proposed plan to build our dock 31 fe`t from your dock would also call for me to be iu -violation of oar riparian line set back on Dick's side (south side) by one to two feet; We can live Rith this if Dick can. In this way, if Dick moves on and the new neiglibers have a problem with it, we could al=ys chop off one to two feet at the end ofthe dock.
