and be readily available on site when Division personnel inspect the project
for compliance.
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.

proposed for the Morehead Ships Chandlers project east of Leeward
Harbor. These changes reflect elimination of part of the fuel
dock and relocation of the fuel pumps. We also would like to build
a 4' wide catwalk along the west current deflector to facilitate
handling of boats as they come off the travel lift. These changes
will result in a net decrease in deck area and will require no
additional excavation. Copies of this proposal have been delivered
to the Leeward Harbor Owners Association.

of regularly or irregularly flooded marsh, behind adequate dikes or other
retaining structures to prevent spillover of solids into any marsh or surroun-
ding waters.
(3) Excavation will not exceed 6 feet below the elevation of mean low water
(MLW).
(4) The bulkhead material will not extend waterward more than 5' from the normal
water level at any point along its alignment.
(5) All wet concrete to, be placed below MHW shall be placed during low tide
with the forms completely dewatered.
(7) The temporary placement or double -handling of excavated or fill materials

(7) The activity must be conducted in such a manner as to prevent significant
increase in turbidity outside the area of construction or construction -related
discharge (increases such that the turbidity in the Stream is 25 NTUs or
less are not considered significant).
(8) The disturbed areas will be properly graded and provided a ground cover
sufficient to restrain erosion within 30 days of project completion.
(9) No attempt will be made by the permittee to prevent the full and free use
by the public or all navigable waters at or adjacent to the authorized work.
Use of the permitted activity must not interfere with the public's right
to free navigation on all navigable waters of the United States.
(10) If the display of lights and signals on the authorized structure is not
otherwise provided for by law, such lights and signals as may be prescribed
by the U. S. Coast Guard will be installed and maintained by, and at the
expense of, the permittee.
(11) It is possible that the authorized structure may be damaged by wavewash
from passing vessels. The issuance of this permit does not relieve the
permittee from taking all proper steps to ensure the integrity of the permitted
.structure and the safety of moored boats from damage by wavewash. The permittee
will not hold the United States liable for any such damage.
(12) This permit does not authorize interference with any existing or proposed
Federal project.
NOTE: The permittee or his contractor is urged to meet with representatives
of the Division of Coastal Management and/or the U. S. Army Corps of
Engineers prior to project initiation.
NOTE: An Erosion and Sedimentation control plan will be required for this project.
This plan must be filed at least thirty (30) days prior to beginning
any land disturbing activity. Submit this plan to the Department of
Natural Resources and Community Development Land Quality Section, 7225
Wrightsville Avenue, Wilmington, NC 28403.

DATE: AUGUST 11, 1987
Attached is a request from Mr. Jenkins for a modification of
Permit #65-87. Basically, this request is to delete an
approximately 40' long by 30' wide hollow core slab platform (a
portion of which was to be placed over the water), and to install
a concrete bulkhead along the entire shoreline. This bulkhead
would adjoin an existing bulkhead on the western property line and
then be at, or landward, of the mean highwater line to the
eastern property line. They would also like to replace the large
(25' by 50') floating dock/wave attenuator on the east side of
the basin with a fixed dock and timber wave breaker.

Dear Sir:
In accordance with the conversation which Bob Griffith of
T. D. Eure Construction Company had with you, we would like to
modify our existing CAMA permit as shown on the enclosed plans.
In essence, we propose to eliminate the 40' long hollow core
slab platform which extended over the water and replace this with
a concrete bulkhead which would join the existing bulkhead on the
west portion of the property and run at or behind the existing
high water mark to the eastern boundary of the property. The layout
of the current deflectors and the floating docks would remain the
same. However, due to cost considerations, we would also like
to replace the large (25' x 50') floating dock/wave attenuator
on the east side of the basin with a fixed timber dock with a timber
wavebreaker, a section of which is shown on the attached plan.

authorizing development in Carteret County at Bogue Sound in Morehead
City as requested in the permittee's application dated 1/22/87 including
attached plats,' sheets/1-8 dated 12/1/86.
This permit, issued on 3l L/ is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) All development will, be conducted in strict accordance with the attached
application and plats.
(2) All excavated materials will be confined above mean high water and landward
of regularly or irregularly flooded marsh, behind adequate dikes or other
retaining structures to prevent spillover of solids into any marsh or surround-
ing waters.
(3) Excavation will not exceed 6�feet below the elevation of mean low water
(MLW).
(4) The riprap material will not extend waterward more than 5' from the normal
water level at any point along its alignment.
(5) The riprap material will be clean and free of any pollutants, except in
trace quantities. Metal products, organic materials, or unsightly debris
will not be used. The riprap must be sized to prevent its movement from

This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31. 1990
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

(6) All wet concrete to be placed below MHW shall be placed during low tide
with the forms completely dewatered.
(7) The temporary placement or double handling of excavated or fill materials
within waters or vegetated wetlands is not authorized.
(8) The activity must be conducted in such a manner as to prevent significant
increase in turbidity outside the area of construction or construction -related
discharge (increases such that the turbidity in the Stream is 25 NTUs or
less are not considered significant).
N) The disturbed areas will be properly graded and provided a ground cover
sufficient to restrain erosion within 30 days of project completion.
(10) No attempt will be made by the permittee to prevent the full and free use
by the public of all navigable waters at or adjacent to the authorized
work. Use of the permitted activity must not interfere with the public's
right to free navigation on all navigable waters of the United States.
(11) If the display of lights and signals on the authorized structure is not
otherwise provided for by law, such lights and signals as may be prescribed
by the U.. S. Coast Guard will be installed and maintained by, and at the
expense of, the permittee.

from passing vessels. Tysuance of this hermit does not relieve the
permittee from taking all p'ftrp"steps to ensure the integrity of the permitted
structure and the safety of moored boats from damage by wavewash. The
permittee will not hold the United States liable for any such damage.
(13) This permit does not authorize interference with any existing or proposed
Federal project.
NOTE: The permittee or his contractor is urged to meet with representatives
of the Division of Coastal Management and/or the U. S. Army Corps of Engineers
prior to project initiation.
NOTE: An Erosion and Sedimentation control plan will be required for this project.
This plan must be filed at least thirty (30) days prior to beginning any
land disturbing activity. Submit this plan to the Department of Natural
Resources and Community Development, Land Quality Section, 7225 Wrightsville
Avenue, Wilmington, NC 28403.

The applicant proposes to redevelop a tract of land adjacent to Morehead City
Harbor Channel, classified SC. This development will include the construction of
boat ramp and two jetties. The project has been reviewed to determine impacts
on water quality. The following comments are provided:
1. The proposed project will require a 401 Certification.
2. It is recommended that the following conditions be included in the 401
Certification:
a. That all construction and demolition work be done in such a manner as
to prevent turbidity levels from increasing to greater than 25 NTUs
outside the work area.
b. That the rip -rap material be of such size so as not able to be carried off
by wave action and consist of clean rock or masonry material free of
debris or toxic pollutants.
c. That all wet concrete poured below MHW be poured during low tide with
the form(s) completely dewatered.
This office has no objection to the project as proposed providing the above

Reference the application of Morehead Ships Chandler,
Incorporated, represented by Mr. Bill Jenkins, for a Department of
the Army permit to construct a dry stack storage facility with
associated docking facilities and shoreline stabilization on Bogue
Sound, Morehead City, Carteret County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. The riprap material will be placed in strict accordance
with the permit plans.
b. The riprap material will be clean and free of any
pollutants except in trace quantities. Metal products, organic
materials, or unsightly debris will not be used.
C. All excavated materials will be confined landward of the
mean high water (MHW) elevation contour and any regularly or
irregularly flooded vegetated wetlands.
d. Excavation will not exceed 6 feet below the elevation of
mean low water (MLW).

construction activities that receive authorization from the State
of North Carolina.

facility with associated docking facilities and shoreline
stabilization in Bogue Sound, Morehead City, Carteret County,

8. :Project summary Applicant proposes to redevelop a parcel located
on harbor Channel and the east end of Arende_ll Street, Morehead City,
Carteret County. A drystack storage project is proposed.

9. Narrative description
Applicant's property is a parcel approximately one and one-half
acres in size, located on Harbor Channel which empties into Bogue
Sound. The property is located on the extreme east end of
Arendell Street between the Leeward Harbor Condominium and J.M.
Davis Texaco in the Town of Morehead City in Carteret County.
The property is characterized by 4-6' elevations on which three
cinder block structures had been constructed to provide
facilities for the old Parker Ford Dealership which existed at
this site in the early to mid 70's. These structures are
presently in a serious state of decay.
The portion of the property bordering Arendell Street is
presently paved, however, this stops approximately mid -way the
property as you move towards the water, and the remaining portion
of the property is either grass or barren. The shoreline is
characterized by a bulkhead on the side bordering the Leeward
Harbor Condominium project and a rock revetment on the remaining
shoreline segments. A pier exists in the central portion of the
property and extends offshore approximately 2401. The applicant
is proposing to remove the existing buildings and asphalt from
the highgrour_d portions of the lot and the pier from the adjacent
waters. The applicant is then planning to redevelop the entire
trach, constructing a dry stack storage building 253' long by
105' high by 50' high, approximately in the central portion of
the property and paving the landward end and side of this
property in order to provide parking for patrons of this dry
stack storage business. On the shoreline a paved ramp area for
launching boats is proposed on the eastern portion of the
property, maintaining a 15' separation from the J. M. Davis
facility, and on the western portion of the property, a series of
floating docks are proposed along with some proposed fuel pumps.
Immediately offshore of the area to be used for launching the
vessels will be a floating dock which will also serve as a wave
deflector to protect the launching operation. On either side of
the launching area will be jetties approximately 60' in length
which will be formed from concrete sheet piles. These jetties
are proposed in order to deflect the high currents that exist in
this area and also to protect the boat launching area from
unnecessary sedimentation. The area between the two jetties is
proposed to be excavated to a depth of -6' MLW and this
excavation will cover an area approximately 40' wide by 60' long.

10. Anticipated Impacts
Conducting this project as proposed will involve the disturbance
of approximately 2400 sq. ft. of shallow subtidal water area
where the basin is planned, and another 1280 sq. ft. will be
disturbed in reconstituting the presently existing rock
revetment. The highground grading and construction will involve
the disturbance of 67,500 sq. ft.
Adjacent waters are classified as SC according to the Division of
Environmental Management and are presently closed'to shell
fishing by the Division of Health Services.

I have no objections to this project as proposed as long as the
following conditions are met:
1. The riprap material will not extend waterward more than 5'
from the normal water level at any point along its alignment.
2. All excavated materials will be confined above mean high
water and landward of regularly or irregularly flooded marsh,
behind adequate dikes or other retaining structures to prevent
spillover of solids into any marsh or surrounding waters.
3. All development will be conducted in strict -accordance with
the attached application and plats.
4. The disturbed areas will be properly graded and provided a
ground cover sufficient to -restrain erosion within 30 days of
project completion.
5. The riprap material must be free from loose dirt or any
other pollutant in other than trace quantities.
NOTE: The permitee or his contractor is urged to meet with
representatives of the Division of Coastal Management and/or the U.S.
Army Corps of Engineers prior to project initiation.
Note: The Town of Morehead City is currently negotiating with the
applicant about parking requirements. A copy of this application
should be sent to them in order to ensure that their comments are
incorporated into our permit review.

The Department of Natural Resources and Community Development hereby
gives public notice as required by NCGS 113A -119(b) and 143-215 3(a)(1)
(C) that Morehead Shios Chandler, Inc. of Morehead -City
North Carolina filed an application on February

of Environmental Management that a discharge of fill material in project

1) This permit authorizes only the docks, piers, and other structures and
uses located in or over the water that are expressly and specifically set
forth in the permit application. No other structures, whether floating
or stationary, may become a permanent part of this marina without permit
modification. No non -water dependent uses of structures may be conducted
on, in, or over public trust waters without permit modification.
2) No attempt will be made by the permittee to prevent the full and free use
by the public of all navigable waters at or adjacent to the authorized
work. Use of the permitted activity must not interfere with the public's
right to free navigation on all navigable waters of the United States.
3) This permit does not authorize the interference with any existing or
proposed Federal project, and the permittee will not be entitled to
compensation for damage or injury to the authorized structure or work
(See attached sheet for additional conditions)
This permit action may be appealed by the permittee or
other qualified persons within.twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on

This permit, issued on May 18, 1993 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be
subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
1) This permit authorizes only the docks, piers, and other structures and
uses located in or over the water that are expressly and specifically set
forth in the permit application. No other structures, whether floating
or stationary, may become a permanent part of this marina without permit
modification. No non -water dependent uses of structures may be conducted
on, in, or over public trust waters without permit modification.
2) No attempt will be made by the permittee to prevent the full and free use
by the public of all navigable waters at or adjacent to the authorized
work. Use of the permitted activity must not interfere with the public's
right to free navigation on all navigable waters of the United States.
3) This permit does not authorize the interference with any existing or
proposed Federal project, and the permittee will not be entitled to
compensation for damage or injury to the authorized structure or work
(See attached sheet for additional conditions)
This permit action may be appealed by the pennittee or
other qualified persons within twenty (20) days of the
issuinG date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the pen -nit expires on

8. PROJECT SUMMARY: The applicant is proposing to replace a floating pier with a fixed one and
construct a wave -breaker.

9. NARRATIVE DESCRIPTION: The Portside Manna is located at 203 Arendell
Street, in the Town of Morehead City, Carteret County. CAMA Permit #65-87
authorized the construction of an approximately 196 space "drystack" storage facility
on the highground property and also included, the placement of fixed and floating piers
in Harbor Channel to accommodate 10 boats. All construction activities authorized by
this permit has been completed, and, the permit has expired.
The recent storm destroyed the waterward floating pier and the applicant now wishes to
replace this structure with a fixed one. The pier would be approximately 100' in
length x 6' in width and would be within the "footprint" of the previously authorized
structure. A wooden wave -breaker would also be constructed on the waterward side of
this pier. The wave -breaker would terminate just below the MLW line and the vertical
sheeting would be placed as close as possible to one another.
10. ANTICIPATED IMPACTS: The project, as proposed, will result in the replacement
of a floating pier with a fixed one within the same footprint. A wave -breaker would be
constructed on the waterward side in an attempt to dissipate waves generated from
wind and boat traffic. Because of the strong tidal influence at this location, the wave -
breaker should not adversely impact water circulation in the basin.

Reference the application of Portside Marina, represented by Mr. Bill
Young, for a Department of the Army permit to replace a pier and construct a
wave break structure on Bogue Sound, Portside Marina, Morehead City, Carteret
County, North Carolina.
The Federal agencies have completed review of the proposal as presented by
the application and your field investigation report.
We recommend that the following conditions be included in the State
authorization:
a. All work authorized by this permit must be performed in strict
compliance with the permit plans.
b. No attempt will be made by the permittee to prevent the full and free
use by the public of all navigable waters at or adjacent to the authorized
work. Use of the permitted activity must not interfere with the public's
right to free navigation on all navigable waters of the United States.
C. This permit does not authorize the interference with any existing or
proposed Federal project, and the permittee will not be entitled to
compensation for damage or injury to the authorized structure or work which
may be caused from existing or future operations undertaken by the United
States in the public interest.
d. Approval of the structure was based on determination that there would
be no obstruction to navigation. Under conditions existing in the Atlantic
Intracoastal Waterway (AIWW), a possibility exists that the structure may be
damaged by wave wash from passing vessels. Unreasonable slowing down of
vessel traffic cannot be required because it would tend to nullify the
navigational benefits on which the AIWW was justified. Issuance of this
permit should not be construed as relieving the permittee of taking proper
steps to insure the structure and moored boats will not be damaged by wave
wash normally to be expected in the AIWW.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored
form) is retained by you and it must be available on site when the project is inspected for compliance. Please sign
both the original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and
proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office
of Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, [phone] within twenty (20) days of
this decision on your permit. You should also be aware that if another qualified party submits a valid objection to
the issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carred out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully
understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request
that you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel
at any time for assistance. By working in accordance with the permit, you will be helping to protect our vitally
important coastal resources.

The Division of Coastal Management hereby acknowledges receipt of your application

adjacent to Harbor Channel, in the Town of Morehead City, Carteret County. It was
received on April 21, 1993, and appears to be adequate for processing at this time. The
projected deadline for making a decision is July 6, 1993._ An additional 75 -day review
period is provided by law when such time is necessary to complete the review. If you have
not been notified of a final action by the initial deadline stated above, you should consider
the review period extended. Under those circumstances, this letter will serve as your notice
of an extended review. However, an additional letter will be provided on or about the 75th
day.
NCGS 113A -119(b) requires that Notice of an application be posted at the location of
the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard
which must be posted at the property of your proposed development. You should post this
notice at a conspicuous point along your property where it can be observed from a public
road. Some examples would be: Nailing the notice card to a telephone pole or tree along the
road right-of-way fronting your property; or at a point along the road right-of-way where a

I have no objections to the issuance of this permit with the following conditions:
1. This permit authorizes only the docks, piers, and other structures and uses located in
or over the water that are expressly and specifically set forth in the permit
application. No other structures, whether floating or stationary, may become a
permanent part of this marina without permit modification. No non -water dependent
uses of structures may be conducted on, in, or over public trust waters without permit
modification.
2. No attempt will be made by the permittee to prevent the full and free use by the
public of all navigable waters at or adjacent to the authorized work.
3. The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized
facilities.
4. This permit does not authorize the interference with any existing or proposed Federal
project, and, the permittee will not be entitled to compensation for damage to the
authorized structure or work, or injury which may be caused from existing or future
operations undertaken by the United States in the public interest.

DATE: April 26, 1993
Portside Marina is located at 203 Arendell Street, adjacent to Harbor Channel, in Morehead
City, Carteret County.
A previously authorized permit provided for construction of an approximately 196 space dry
stack boat storage facility and the placement of fixed and floating piers in Harbor Channel to
accommodate 10 boats. The permit which authorized these activities has expired.
A recent storm destroyed a floating pier which the applicant now wishes to replace with a
fixed pier. A wooden wave -breaker would also be constructed on the waterward side of this
pier.
AECs impacted by this project include Public Trust and Estuarine Waters.
I have reviewed this project for consistency with the 1991 Town of Morehead City Land Use
Plan (LUP) Update and offer the following comments.
The general area of the project is classified 'Developed', while the AECs impacted by the
project are classified as 'Conservation'. At this location, the waters are not classified as a
Primary Nursery Area (PNA).
The Town's policies for development in Estuarine Waters and Public Trust Areas that are not
PNAs are consistent with the CAMA 7H Use Standards.
Provided this project can be permitted in accordance with the 7H Use Standards, this project
appears consistent with the 1991 Town of Morehead City LUP Update.

On February 11, 1991, we renewed general permit No. CESAW-C080-N-000-0291
(copy enclosed), which provides Federal authorization for construction
activities that receive authorization from the State of North Carolina.
A review of your application received April 23, 1993, for Department of
the Army authorization to replace a pier and construct a wave break structure
on Bogue Sound, Portside Marina, Morehead City, Carteret County, North
Carolina, indicates it to be a candidate for Federal authorization under this
general permit. Accordingly, the administrative processing of your
application will be accomplished by the North Carolina Division of Coastal
Management. Comments from Federal review agencies will be furnished to the
State.
If your application must be withdrawn from this general permit process for
any reason, you will be informed regarding its further management. If there
are no unresolved differences in State -Federal positions or policies, the
final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the
general permit and you may commence your activity. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and Harbor Act, has
been assigned Action ID No. 199302145 and will be coordinated by Mr. Scott
McLendon in our Wilmington Field Office. He is available at telephone (919)
251-4725.

impact fish and wildlife resources. However, because of staffing
limitations we have elected not to conduct a field inspection of
the project and no further action is anticipated. If, prior to
permit issuance, further information becomes available which
affects our position, we will forward supplemental comments to
your office. Under no condition should this response be
construed as a "no objection" report.

In accordance with Section 7 of the Act, it is the responsibility
of the appropriate Federal agency (in this case, the Corps of
Engineers) to review its activities or programs and to identify
any such activity or program that may affect endangered or
threatened species or their habitat. If it is determined that a
proposed activity may affect any species listed as endangered or
threatened or designated critical habitat, further consultation
with this office is necessary. If it is determined that a
proposed activity may jeopardize the continued existence of a
species proposed for listing, or adversely modify or destroy
proposed critical habitat, you must initiate a conference with
this office.
If this project is determined to be a major Federal action,
having significant impact on the human environment and requiring
an environmental impact statement, you should formally request
from us a list of endangered and threatened species which may
occur within the impact area of this project. Please advise us of
any action taken by your office in this matter.
