(1) This permit modification authorizes a revised dock and wave brake layout in keeping with the attached plat dated received February 19, 1988. (2) All conditions of a modified version of this permit issued on August 19, 1987 remain in effect, except as modified by this permit. We also would like to build a 4' wide catwalk along the west current deflector to facilitate handling of boats as they come off the travel lift. These changes will result in a net decrease in deck area and will require no additional excavation. Copies of this proposal have been delivered to the Leeward Harbor Owners Association. Permit #65-87 Page 2 of 2 (7) The activity must be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction -related discharge (increases such that the turbidity in the Stream is 25 NTUs or less are not considered significant). (8) The disturbed areas will be properly graded and provided a ground cover sufficient to restrain erosion within 30 days of project completion. (9) No attempt will be made by the permittee to prevent the full and free use by the public or all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. (10) If the display of lights and signals on the authorized structure is not otherwise provided for by law, such lights and signals as may be prescribed by the U. S. Coast Guard will be installed and maintained by, and at the expense of, the permittee. (11) It is possible that the authorized structure may be damaged by wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the permitted .structure and the safety of moored boats from damage by wavewash. The permittee will not hold the United States liable for any such damage. (12) This permit does not authorize interference with any existing or proposed Federal project. NOTE: The permittee or his contractor is urged to meet with representatives of the Division of Coastal Management and/or the U. S. Army Corps of Engineers prior to project initiation. NOTE: An Erosion and Sedimentation control plan will be required for this project. This plan must be filed at least thirty (30) days prior to beginning any land disturbing activity. JONES SUBJECT: REQUEST FOR PERMIT MODIFICATION #65-87, BILL JENKINS, BOGUE SOUND, CARTERET COUNTY DATE: AUGUST 11, 1987 Attached is a request from Mr. Jenkins for a modification of Permit #65-87. Basically, this request is to delete an approximately 40' long by 30' wide hollow core slab platform (a portion of which was to be placed over the water), and to install a concrete bulkhead along the entire shoreline. This bulkhead would adjoin an existing bulkhead on the western property line and then be at, or landward, of the mean highwater line to the eastern property line. They would also like to replace the large (25' by 50') floating dock/wave attenuator on the east side of the basin with a fixed dock and timber wave breaker. I have no objections to this modification conditions applicable, except condition #4 the bulkhead will not extend more than 5' level at any point along this alignment." should be deleted. D. Eure Construction Company had with you, we would like to modify our existing CAMA permit as shown on the enclosed plans. In essence, we propose to eliminate the 40' long hollow core slab platform which extended over the water and replace this with a concrete bulkhead which would join the existing bulkhead on the west portion of the property and run at or behind the existing high water mark to the eastern boundary of the property. The layout of the current deflectors and the floating docks would remain the same. However, due to cost considerations, we would also like to replace the large (25' x 50') floating dock/wave attenuator on the east side of the basin with a fixed timber dock with a timber wavebreaker, a section of which is shown on the attached plan. A drystack storage project is proposed. 9. Narrative description Applicant's property is a parcel approximately one and one-half acres in size, located on Harbor Channel which empties into Bogue Sound. The property is located on the extreme east end of Arendell Street between the Leeward Harbor Condominium and J.M. Davis Texaco in the Town of Morehead City in Carteret County. The property is characterized by 4-6' elevations on which three cinder block structures had been constructed to provide facilities for the old Parker Ford Dealership which existed at this site in the early to mid 70's. These structures are presently in a serious state of decay. The portion of the property bordering Arendell Street is presently paved, however, this stops approximately mid -way the property as you move towards the water, and the remaining portion of the property is either grass or barren. The shoreline is characterized by a bulkhead on the side bordering the Leeward Harbor Condominium project and a rock revetment on the remaining shoreline segments. A pier exists in the central portion of the property and extends offshore approximately 2401. The applicant is proposing to remove the existing buildings and asphalt from the highgrour_d portions of the lot and the pier from the adjacent waters. The applicant is then planning to redevelop the entire trach, constructing a dry stack storage building 253' long by 105' high by 50' high, approximately in the central portion of the property and paving the landward end and side of this property in order to provide parking for patrons of this dry stack storage business. On the shoreline a paved ramp area for launching boats is proposed on the eastern portion of the property, maintaining a 15' separation from the J. M. Davis facility, and on the western portion of the property, a series of floating docks are proposed along with some proposed fuel pumps. Immediately offshore of the area to be used for launching the vessels will be a floating dock which will also serve as a wave deflector to protect the launching operation. On either side of the launching area will be jetties approximately 60' in length which will be formed from concrete sheet piles. These jetties are proposed in order to deflect the high currents that exist in this area and also to protect the boat launching area from unnecessary sedimentation. The area between the two jetties is proposed to be excavated to a depth of -6' MLW and this excavation will cover an area approximately 40' wide by 60' long. A 10. Anticipated Impacts Conducting this project as proposed will involve the disturbance of approximately 2400 sq. ft. of shallow subtidal water area where the basin is planned, and another 1280 sq. ft. will be disturbed in reconstituting the presently existing rock revetment. The highground grading and construction will involve the disturbance of 67,500 sq. ft. Adjacent waters are classified as SC according to the Division of Environmental Management and are presently closed'to shell fishing by the Division of Health Services. Submitted by: Nelson G. NARRATIVE DESCRIPTION: The Portside Manna is located at 203 Arendell Street, in the Town of Morehead City, Carteret County. CAMA Permit #65-87 authorized the construction of an approximately 196 space "drystack" storage facility on the highground property and also included, the placement of fixed and floating piers in Harbor Channel to accommodate 10 boats. All construction activities authorized by this permit has been completed, and, the permit has expired. The recent storm destroyed the waterward floating pier and the applicant now wishes to replace this structure with a fixed one. The pier would be approximately 100' in length x 6' in width and would be within the "footprint" of the previously authorized structure. The wave -breaker would terminate just below the MLW line and the vertical sheeting would be placed as close as possible to one another. 10. ANTICIPATED IMPACTS: The project, as proposed, will result in the replacement of a floating pier with a fixed one within the same footprint. A wave -breaker would be constructed on the waterward side in an attempt to dissipate waves generated from wind and boat traffic. A previously authorized permit provided for construction of an approximately 196 space dry stack boat storage facility and the placement of fixed and floating piers in Harbor Channel to accommodate 10 boats. The permit which authorized these activities has expired. A recent storm destroyed a floating pier which the applicant now wishes to replace with a fixed pier. A wooden wave -breaker would also be constructed on the waterward side of this pier. AECs impacted by this project include Public Trust and Estuarine Waters. I have reviewed this project for consistency with the 1991 Town of Morehead City Land Use Plan (LUP) Update and offer the following comments. The general area of the project is classified 'Developed', while the AECs impacted by the project are classified as 'Conservation'. At this location, the waters are not classified as a Primary Nursery Area (PNA). The Town's policies for development in Estuarine Waters and Public Trust Areas that are not PNAs are consistent with the CAMA 7H Use Standards.
