adjacent riparian landowners certifying that they have no

I received a request to waive the 15 foot setback requirement for the construction of a bulkhead
on the property of Col. Dan Peters, Lot 2 Section 3 - phase 1 Cherry Branch West, Dory Court,
Havelock, NC 28532 on July 26, 1999. I do not wish to waive the 15 foot setback requirement.
Stabilization of the Neuse River bank has been a significant concern of the Forest Service for
many years. At some locations, bank erosion rates have averaged as much as three feet per year
over the last 40 years. It has been our experience that artificially hardened banks, while protect-
ing a particular site, tend to increase the erosion on adjacent sites. This increased erosion is from
the excess energy that normally would have been dissipated on the hardened site. For this reason
I do not wish to waive the setback requirement.

Dear Mr. Ramey:
This correspondence is in reference to your letter of July 30, 1999 whereby you expressed
concern about a bulkhead proposed by Col. Dan Peters adjacent to Forest Service property. The
project is located off Dory Court, at lot #2, Section 3, phase I at Cherry Branch West, near
Havelock, in Craven County, North Carolina. The proposed bulkhead would be 100' in width and
would abut Forest Service property above the normal water line. You specifically stated that the
Forest Service does not wish to waive any setback.
The North Carolina Division of Coastal Management has given your concerns careful
consideration and has determined that the project is consistent with the appropriate rules and
regulations of the Division. Specifically, a waiver is not required to construct a bulkhead up to
the common property line. Consequently, the Division issued a general permit to Col. Peters on
August 10, 1999 for the aforementioned project in accordance with NCAC T15A: 07H.1100
General Permit for Construction of Bulkheads and the Placement of Riprap for Shoreline
Protection in Estuarine and Public Trust Waters.
If you wish to appeal this permit decision, you may file a request with the Director of the
Division of Coastal Management, Department of Environment and Natural Resources within 20
days of the permit decision. If you have any questions regarding this matter, please don't hesitate
