is a subsequent determination that a permit was required for the
development.

THIS EASEMENT, made and entered into this 27 day of April
1966, by and between the STATE OF NORTH CAROLINA, party of the first part,

and MANLY MORTON AND MOODY MORTONY of Carteret County, North Carolina,
parties of the second part;
WITNESSE'PH:
THAT WHEREAS, the North Carolina Department of Administration

authorized and approved the execution of this instrument for the purposes
herein set forth; and
WHEREAS, the execution of this instrument for and on behalf of

the State of North Carolina has been duly approved by the Governor and
Council of State at a meeting held in the City of Raleigh, North Carolina,
on the day of 1966.
NOW, TIJEREI'ORE, in consideration of the premises'and in further
consideration of the sum of ONE DOLL!M (;;1.00), paid by.the parties of
the second part to the party of the first part, the receipt of which is
hereby acknowledged, the State of North Carolina, subject tothe terms
and conditions hereinafter set forth, does hereby grant to Manly Morton
and Moody Morton, their heirs and assigns, a right of tray and easement
for the prupose of ingress and egress, and regress, to those certain
structures constructed by the parties of the second part in the navigable
waters of Bogue Sound, across the lands of the party of the first part,
said lands lying and being in Broad Creek Community, Carteret County,

North Carolina, and more particularly described as .follows:
That certain tract or parcel of land lying and being
of Broad Creels, '
in the waste party of the community-
south side, Carteret County, at the southernmost end
of an unpaved community road (maintained.by the Stato�.
Highway Commission) extending from the -main community
p aved road -connecting with N. C. Highway and

which unpaved road extends down to the, waters of the ;
Creek where presently are located small Seafoods
houses'.owned. by Manly Morton and others, and
BEGINNING at a concrete 'marker or post, in the eastern
line of the right-of-way of said road, and which

highway right-of-way it -about
waters of.,Broad Creek, and running with the southern
line of said highway right-of-way a. westerly course
about fifteen (15) feet; thence a southerly course
with the.so-called "made up" land or.land made from
the deposit of excavated material in dredging said
Creek, and the deposit of sLtells, a distance
hundred seventy-five (175) feet, to
approximately one
the waters of said Creek; thence with the waters
feet
said Creek an easterly'course about fifteen (15)
to a point; thence a northerly course about one
(175) feet to the point of

beginning, containing 1113 acre, more,or less.

1. The easement herein granted shad be used solely for the
purposo of ingress and egress and no buildings'.or other structures shall
be- erected thereon.
2. The rights herein granted may be',transferred or assigned by
the parties of the second part; however,. any and all such assignments shall
be subject to the right•of the State, or its authorized agency, to revoke

the same, and the State shall be notified of such assignment before the
same shall be valid and binding. In the event of revocation of the I
l easement herein granted, the State or -its duly authorized agency shall i
give 60 days written notice to -the parties of the second part or their
assigns of its intent to revoke..
TO HAVE•AND TO HOLD,.the aforesaid' right of way and easement
unto the parties of the second*part and.their assigns, for so..long as
used for the purposes hereinbefore expressed or until revoked by .the State.
