This permit is subject to compliance with this application, site
drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine,
imprisonment or civil action; and may cause the permit to be-
come null and void.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
adjacent riparian landowners certifying that they have no
objections to the proposed work.

PUBLIC NOTICE

MRS. SARA MEADOWS, 500'8th Street, New Bern, North Carolina 28560, has made application for
a Department of the Army permit TO -PERFORM MAINTENANCE EXCAVATION OF AN EXISTING BOAT BASIN
ADJACENT TO SLEEPY CREEK, NEAR,GLOUCESTER, Carteret County, North Carolina.
Plans submitted with the application show the proposed maintenance of a 140-foot long boat
basin varying in width from 25 to 35 feet. The basin is to be maintained.to a depth of
-4 feet by means of a dragline, and the excavated material will be either hauled away by
truck or placed on high ground. The purpose of the project is for the maintenance of an
existing boat basin. Plans showing the proposed work are included with this public notice.
Applicant has applied to the NC Department of Natural and Economic.Resources for a permit to
excavate and fill. No Department of the Army permit will be issued until the coordinated
State viewpoint on the proposal has been received and reviewed by this agency, nor will a
Department of the Army permit be issued until the NC Office of Environmental Management has
determined the applicability of a Water Quality Certificate as required by PL 92-500.
Approval of this permit will give Federal authorization for maintenance dredging for a
period not to exceed 10 years from the date of issuance. Applicant will be required to
present plans for maintenance to the District Engineer a minimum of 2 weeks prior to
commencement of work. All maintenance is to be performed in accordance with Federal, State
and local regulations governing such activities at the time the maintenance is undertaken.
A. review of all information available at the time of this notice indicates that the work
will not have a significant effect on the quality of the human environment. The action does
not appear to constitute a major Federal action significantly affecting the quality of the
human environment; therefore, the preparation of a detailed statement under Section 102(2)(c)
of the National Environmental Policy Act of 1969 will not be required at this time.
This application is being considered pursuant to Section 10 of the River and Harbor Act of
1899 (33 U.S.C. 403) and Section 404(b) of the Federal Water Pollution Control Act Amendments
of 1972 (33 U.S.C. 1344). Any person who has an interest which may be adversely affected by
the issuance of a permit may request a public hearing.. The request must be submitted in
writing to the District Engineer within 30 days of the date of this notice and must clearly
set forth the interest which may be adversely affected and the manner in which the interest
may be adversely affected by the activity.
The decision whether to issue a permit will be based upon evaluation of the probable impact
of the proposed activity on the public interest and will include application of the guidelines
promulgated by the Admipistrator, Environmental Protection Agency, under authority of
Section 404(b) of the Federal Water Pollution Control Act. That decision will reflect the
national concern for both protection and utilization of important resources. The benefit
which reasonably may be expected to accrue from the proposal must be balanced against its
reasonably foreseeable detriments. All factors which may be relevant to the proposal will
be considered; among those are conservation, economics, esthetics, general environmental
concerns, historic values, fish and wildlife values, flood damage prevention, land use
classification, navigation, recreation, water supply, water quality, and in general, the
needs and welfare of the people. No permit will be granted unless its issuance is found to
be in the public interest.
Written comments pertinent to the proposed work, as outlined above, will be received in this
office, ATTN: Mr. Robert C. Daum, until 4:45 p.m., 14 July 1975.
