The proposed project to be located and constructed as described
above is hereby certified as exempt from the CAMA permit re-
quirement pursuant to 15 NCAC 7K .0203. This exemption to
CAMA permit requirements does not alleviate the necessity of
your obtaining any other State, Federal, or Local authorization.
This certification of exemption from requiring a CAMA permit is
valid for 90 days from the date of issuance. Following expiration,
a re-examination of the project and project site may be necessary
to continue this certification.

Any person who proceeds with a development without the con-
sent of a CAMA official under the mistaken assumption that the
development is exempted, will be in violation of the CAMA if there
is a subsequent determination that a permit was required for the
development.
The applicant certifies by signing this exemption that (1) the ap-
plicant has read and will abide by the conditions of this exemp-
tion, and (2) a written statement has been obtained from adjacent
landowners certifying that they have no objections to the
proposed work.

This is in reference to your letter of February 14, 1997 concerning the plans of Casper's Marina to
rebuild a dock which was damaged/destroyed by Hurricane Fran. Mr. Casper has requested permission
to rebuild the dock to its original footprint and dimensions except the width of the dock is to be reduced
to 8' and a 30' long x 8' wide section of the "T" dock is to be relocated to west end. This would move
the "T" dock farther away from your property line.
A "Storm" Exemption was issued to Mr. Casper on April 3, 1997 authorizing the reconstruction of the
dock as described above. This authorization is consistent with the emergency storm procedures imposed
after last year's hurricanes. A copy is enclosed for your review.

Would you please answer the following questions:
1. How can this be permitted as a modification to existing dock when there is no dock
and there is no way it can come under the 50% rule because every piling will have to be
reworked.
2. Why does this drawing show no riparian measurements for adjoining properties?
3. Does Mr. Casper's application contain deeds showing ownership and footage of his
property?
4. I thought Mr. Casper was exempt from any CAMA requirements because he just
finished a building that the inspector had a stop work order on until he received a CAMA
permit.
5. A written response is requested.
