The proposed project to be located and constructed as described
above is hereby certified as exempt from the CAMA permit re-
quirement pursuant to 15 NCAC 7K .0203. This exemption to
CAMA permit requirements does not alleviate the necessity of
your obtaining any other State, Federal, or Local authorization.
This certification of exemption from requiring a CAMA permit is
valid for g0 days from the date of issuance. Following expiration,
a re-examination of the project and project site may be necessary
to continue this certification.

Any person who proceeds with a development without the con-,,----
sent of a CAMA official under the mistaken assumption that the — = Applicant

plicant has read and will abide by the conditions of this exemp-
tion, and (2) a written statement has been obtained from adjacent
landowners certifying that they have no objections to the
proposed work.

we have reviewed the information submitted to this office
on your inquiry concerning the necessity of filing an application
for a minor development permit under the Coastal Area Management
Act. The activity you proposed is exempt from needing a minor
development permit as long as it meets the conditions specified
below. T; ,,our clans should change and your project will no

A private, noncommercial pier may be constructed if it does
not exceed 200 feet in total length offshore, is not within 150
feet of a federally maintained channel, does not extend beyond
the 4 foot mean low water contour line of the water body, does
not exceed ? feet in width, .and does not include an enclosed
srr•-,cture, and does not interfere wit:: established navigation
rights. Tt may be built through wetland vegetation only if
elevated and may have a T-head or platform not exceeding 500
square feet in area at its waterward end -if no wetland areas are
covered. The pier must be set` -back a minimum of 15 feet from the
adjacent property owner's area of riparian access unless waived
by a written agreement. The pier shall not extend beyond the
established pier length along the same shoreline for similar use
and it no case extend more than one-third of the width of the
water body and shall not interfere with shell fish franchises or
leases.
"This letter of exemption is valid for a period of 90 days only. -A new
application will need to be submitted if construction is not commenced within
that time."
