Any violation of these terms may subject the permittee to a fine, imprisonment or civil action; and may cause the permit to be- come null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) this pro- ject is consistent with the local land use plan and all local ordinances, and 2) a written statement has been obtained from adjacent riparian landowners certifying that they have no objections to the proposed work. January 5, 1998 C) 101 Manatee Street Ott% Swansboro, NC 28584 Dear Mr. Buck, I am writing to you with regard to the CAMA Minor Permits you applied for in the name of Vision Properties, L.L.C., for development of lots in Indian Beach. Specifically, these were CAMA applications for Lots 14, 5, 6, 7, and 1 in Sea Isle Plantation, and a lot east of Hoffman Beach Subdivision and west of Colony by the Sea. The applications were for the grading and filling of the above mentioned lots. Similar proposals have been made in Emerald Isle, and have been evaluated by Dan Sams of the N. C. Division of Land Quality for compliance with the NC Sedimentation Pollution Control Act. It is the determination of Mr. Sams that those proposals require a sedimentation/erosion control plan approved through his office. In accordance with NC General Statutes 113A-118, a CAMA Major Permit shall be required when "any development requires permission, licensing, approval, certification or authorization in any form from ...... the North Carolina Sedimentation Control Board...." As such, the CAMA Minor Permit process is not available for the work proposed in the above mentioned applications. Likewise, the same would hold true for the applications you submitted. The CAMA major permit process is available for this type of development, and I am enclosing the appropriate application. I am also enclosing a copy of Mr. Sams assessment.
