Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythat this project is consistentwith the North Carolina Coastal Management Program.

Re — Adjacent Riparian Property Owner Statement for proposed dock construction at 612 Emerald Dr.
Dear CAMA Representative,
I am in receipt of an "Adjacent Riparian Property Owner Statement" for dock construction at 612 Emerald
Dr. It was submitted by the contractor, Turner Marine Construction of Morehead City and is dated April 2,
2007. While I do not object to the construction of the dock itself, I am hereby obiectin to o the construction
if the placement of said dock does not reMect the 15' setback from the ACTUAL property line between
610 and 612 Emerald Dr.
The owner of 612 Emerald Dr, Mr. Richard Hunter, has unlawfully constructed a seawall and a fence that
extends 17' over onto our property in total disregard to our property rights. We have notified him, and
asked him to cease and desist, to no avail.
We have repeatedly validated the property line as dictated by Carteret County Registrar of Deeds. It has
been validated by a Title search conducted by our attorney. And we have verified our property line in two
separate surveys by two separate, distinquished, and reputable surveyors who have over 45 years combined
experience surveying on Emerald Isle. One has agreed to testify in court.
I am hereby officially objecting to the dock construction UNLESS the dock placement respects the
15' setback from the ACTUAL property line as recorded in the Carteret County Registrar of Deeds.
The way to determine this is to consider that Mr Hunter's fence line and seawall extend 17' onto our
property line Thus if the placement of the dock respects the 15' setback from the actual property line,
then it would be 32' (17' + 15') from Mr. Hunter's unlawful fence line and seawall.
Attachments:
1) Survey from Bell & Phillips Surveying dated 3/13/2006 indicating actual property line, plus
incorrect property line.
2) A sketch which further clarifies the unlawful placement of the fence and seawall extending 17'
onto our property, and an explanation that I do not object to the dock construction if it respects the
actual property line and therefore sits 32' from the unlawful fence line and seawall.
3) Copy from Map Book, Carteret County Registrar of Deeds, which also validates our property line.
4) Copy of Deed on our property — 610 Emerald Dr.
